VARIANCE REQUEST Approved by BZA subject to two conditions: 1. The development shall comply with Chapter 24 (Landscaping); 2. A 4 ft. to 6 ft. high black vinyl coated chain link fence shall be constructed on the north property line adjacent to the retention pond.
Special Conditions and Circumstances Not Self Created • Existing Stormwater Easement and plat Stormwater Easement along eastern and southern property boundaries
No Special Privileges Deprivation of Rights • Unable to develop site in same manner as other properties in vicinity that are not subject to easement or subdivision Variance will not result in greater massing or greater developable footprint than what would be permitted without impact of easement Cohesive planned development
Minimum Possible Variance Purpose and Intent • Permits redevelopment of blighted vacant commercial property • Consistent with outparcel development Setback adjacent to retention pond and parking lot Minimum amount needed to accommodate easement
