Mental Health (Wales) Measure 2010 Intended effect Part 1 expand provision of local primary mental health support services Part 2 ensure all service users within secondary care have a care coordinator and a care plan Part 3 provide a mechanism for re-access for previous service users Part 4 expand independent advocacy to all inpatients and all hospital and community sections of Mental Health Act 1983
Implementation programme for Part 1 Statutory duties will come into effect on 1October 2012Subordinate legislation Regulations enabling LHBs and local authorities to agree Part 1 schemes for LHB-wide regions (rather than for each local authority area) were issued for consultation between September- December 2011 Regulations setting out arrangements for enabling individuals not registered with GPs to access services, and who may undertake primary mental health assessments were issued for consultation which closed January 2012

Parts 2 and 3 of the Measure Care and Treatment Planning in Law Part 2 – Care and Treatment Planning for people receiving secondary mental health services ensure all service users care have a care coordinator and a care plan Part 3 – Provides a right for former users of secondary mental health services to refer themselves back to secondary services Former users will not have to go to a GP to be referred
Implementation programme for Part 2 Statutory duties will come into force on 6June 2012 Subordinate legislation Regulations setting out: eligibility for care coordinators; form and content of care and treatment plans; requirements for review and revision of plans; who should be consulted and provided with copies of plans; information for patients discharged from secondary services, and, transitional arrangements. Were passed by the National Assembly for Wales Dec 2011
Implementation programme for Part 3 Statutory duties will come into force on 6 June 2012. Services are required to have arrangements in place for dealing with requests for assessment under Part 3. Subordinate legislation Regulations setting out the 3-year entitlement period were made by the Assembly in October 2011
Chapter 1 Code of Practice Guiding principles Patients and their carers should be involved in the planning, development and delivery of the patient’s care and treatment to the fullest extent possible Clear communication in terms of language and culture is essential to ensure patients and carers are truly involved, and receive the best possible care and treatment. In Wales, this means bilingual (Welsh and English) services should, where possible, be available
Code of Practice Guiding Principles Care and treatment should be comprehensive, holistic and person-focussed Care and treatment planning should be proportionate to need and risk Care and treatment should be integrated and coordinated

Implementation programme for Part 4 Statutory duties come into effect in two phases on 3 January 2012 for short-term, emergency sections on 2 April 2012 for informal inpatients Subordinate legislation Regulations around who may be appointed as an IMHA, independence requirements and other matters were made by the National Assembly in October 2011
Duty to review (section 48) review operation of Parts 1, 2, 3 and 4 duty begins when Parts commence report must be laid before National Assembly for Wales within four years of duties commencing planning work under way, expect a component of qualitative and quantitative evidence in the report(s) Welsh Government’s Duty to Review
