  2. Public Acts 70 and 71 of 2004 transferred the administration of Michigan’s driver education program from the Department of Education to the Department of State. Terri Lynn Land Secretary of State

  3. ADVISORY COMMITTEE PURPOSE • Provided a forum for the driver education community to directly interact with the Secretary of State to identify issues and concerns related to driver education. • Drew upon the vision and expertise of the driver education community to strengthen • the driver education program in Michigan. • Provided input for new legislation to replace the Driver Education and Training Schools Act that expired October 1, 2006.

ADVISORY COMMITTEE MEMBERS • The advisory committee was comprised of representatives from: • Public Schools and Driver Training Schools • Universities Teaching Instructor Preparation • Third Party Testing Organizations • Law Enforcement • Michigan Driver Traffic Safety Education Assoc. • Other Traffic Safety Interest Groups

  5. With the passage of PA 384 of 2006, changes have occurred with the delivery and administration of driver education in Michigan.

  6. Driver education providers will no longer be “Licensed” and/or “Approved.” All providers and instructors will be “Certified.”

  7. DRIVER EDUCATION PROVIDERS

  8. CERTIFICATION APPLICATION 1. Providers will be certified according to the following classifications:

  9. CERTIFICATION APPLICATION • Certified biennially (every two years) • by the Secretary of State. • Certifications will expire exactly two years from date of issuance.

  10. CERTIFICATION APPLICATION 3. Certification applications will be mailed to all existing providers in February 2007. 4. Existing providers may continue to provide driver education if completed certification application is received by June 1, 2007.

  11. FEES • Nonrefundable Application Fees • Teen/adult driver training providers - $225 • Truck driver training providers - $360 (EVERY TWO YEARS) Educational institutions and governmental agencies are exempt from these certification fees.

  12. FEES • Range Approval Fees • Original request to use a range - $125 • Renewal request to use a range - $75 Educational institutions and governmental agencies ARE NOT exempt from range original and renewal fees.

  13. RANGE REQUIREMENTS • Maximum 2 hours counts towards Behind-the-Wheel. • Minimum size of 150’ x 300’. • Communication device. • No less than 4 vehicles. • 2-way traffic (with lane markings) • Points of conflict. • Lesson plans.

  14. PROGRAM REQUIREMENTS • Surety Bond – principal sum increased. Educational institutions and governmental agencies are exempt. • Property damage liability insurance on training vehicles. • Criminal history checks.

  18. PROGRAM REQUIREMENTS • 7. Records maintenance (minimum of four years). • Verification/notification of new instructor. • Classroom location approval. APPROVED

  19. TEEN CURRICULUM • A model segment 1 and segment 2 curriculum will be prescribed. • Adopt curriculum or approval to use an alternative curriculum after September 1, 2007. • Students must successfully pass a written knowledge test in each segment.

  20. SEGMENT 1 • Four or more hours of classroom instruction BEFORE behind-the-wheel instruction begins. • Three or more hours of behind-the-wheel instruction BEFORE classroom instruction concludes. • Behind-the-wheel instruction completed NO LATER THAN three weeks after last day of classroom instruction.

  21. SEGMENT 1 • No more than 2 clock hours of behind-the-wheel range instruction can be substituted for on-the-road. 5. Must receive four or more hours of behind-the-wheel observation time as a passenger during segment 1. • Must have a written agreement or waiver • for one-on-one on-the-road instruction.

  22. SEGMENT 2 • Must successfully complete a segment 1 driver education course. • Must hold a level 1 graduated driver license for at least three continuous months before attending a segment 2 course. • Have 30 hours of supervised driving (at least 2 hours at night).

  23. DRIVER EDUCATION INSTRUCTORS

CERTIFICATION APPLICATION • Certified biennially (every two years) by the Department of State. • Mailed to currently licensed instructors in February 2007. • Available for educational institutions’ and governmental agencies’ instructors through their employer. • Instructor certification application also available on the Department of State Website.

  25. CERTIFICATION APPLICATION 5. Existing instructors may continue teaching driver education if completed certification application is received by June 1, 2007. • Criminal history check is required every four years and a medical report every two years. • Certificate is valid for employment with any provider.

  26. CERTIFICATION APPLICATION 8. PA 384 of 2006 does not require a valid Michigan teaching certificate to teach Driver Education. 9. Conditional certification granted to individuals enrolled in an approved instructor preparation program practicum course. CONDITIONAL

  27. FEES • Nonrefundable Fees • Original Application - $45 • Renewal Application - $45 (EVERY TWO YEARS)

  28. PROFESSIONAL DEVELOPMENT Instructors applying for RENEWAL certification must provide evidence that they meet the professional development criteria established by the Secretary of State.

  29. INSTRUCTOR PREPARATION REQUIREMENTS • Starting September 1, 2007, universities offering instructor preparation must meet standards specified by the Secretary of State. • Driver education instructor preparation program must consist of a MINIMUM OF: • 4 courses • 2 semester hours each • 3 weeks in duration for each course

  30. INSTRUCTOR PREPARATION REQUIREMENTS • Final course is the practicum (classroom and behind-the-wheel instruction) under guidance of a cooperating instructor. Conditional instructor certificate required to participate. • January 1, 2008 – Original teen and adult instructor certificate applicants must meet these requirements. • 4. University teacher preparation instructors must possess: • Master’s Degree in Education • Valid Driver Education Instructor Certificate

  31. DISCIPLINARY ACTIONS REVOKE DENY SUSPEND

  32. CRIMINAL HISTORY Fraud Drug-Related Crimes The Secretary of State shall automatically deny an application for a provider or instructor, or revoke an existing certificate, if a criminal history check indicates a conviction for specified felonies. Criminal Sexual Conduct

  33. DRIVING OFFENSES The Secretary of State shall automatically deny an application or revoke an existing certificate if a driving record check reports serious or multiple offenses. 6 or more points cumulative – prior 2 years 4 or more point conviction – prior 5 years.

  34. OTHER VIOLATIONS OF THE ACT The Secretary of State may deny, suspend, or revoke certifications and/or impose administrative fines for violations of the Act, including but not limited to: • Making untrue or misleading statements in connection with an application. • 2. Permitting or engaging in fraud. • 3. Engaging in an unfair or deceptive practice. • 4. Failing to maintain good moral character. • (Fines shall not exceed $1,000 for each violation.)

  35. SUMMARY OF IMPORTANT DATES June 1, 2007 • Deadline to file application under DEPIA. Sept. 1, 2007 • Deadline for instructor preparation providers to adopt new curriculum which includes a practicum. Jan. 1, 2008 • Instructor applicants must have completed new instructor preparation (which includes practicum). • Instructor professional development options identified.
