Question If you were a president leaving office, what would you do to make sure you had a legacy?
The Problem • Election of 1800: Jefferson v. Adams • Jefferson wins • Adams wants to continue his influence
Adams’ Idea • On his last night in office, Adams creates new judgeships and appoints his buddies to those jobs.
The Next Day… • When Jefferson came into the office, he threw out Adams’ appointments • Eventually one of Adams’ friends sued for his appointment
The Decision: Marbury v. Madison • IF the appointments had been legal, Marbury would have been entitled to the job • BUT the appointments were NOT legal and were void • Established JUDICIAL REVIEW
JUDICIAL REVIEW A principle, not established by the Constitution, where the Supreme Court can deem any actions of the President or Congress to be unconstitutional.
