  1. Overview of the Clean Water Act and the National Pollutant Discharge Elimination System (NPDES) Program in Nebraska 1

  2. Federal Water Pollution Control Act Amendments - 1972 (Continued) • Established NPDES, pretreatment, and construction grants programs • Established compliance dates • Provided for authorization of State NPDES permitting programs • Indicated that permit compliance is a shield • Established significant penalties for permit violations • 2

  3. Clean Water Act - 1977 • Clarified that Federal facilities are subject to State programs • Pretreatment program delegation • Authorized EPA to approve local pretreatment program • Required NPDES States to modify programs to include pretreatment oversight 3

  4. NPDES Statutory Framework • All “point sources” • “Discharging pollutants” • Into “waters of the U.S.” Must obtain an NPDES permit from EPA or an approved State 4

  5. NPDES Permit Program IMACLEAN RIVER 5

  6. Waters of the United States40 CFR §122.2 • Regulatory definition would cover virtually all types of surface waters including: • Rivers and streams • Lakes and ponds • Wetlands • Sloughs • Prairie potholes • Intermittent streams • Territorial seas • Etc.

  7. Waters of the US (continued) • What about groundwater? • May be if a direct hydrological connection • May be “Waters of the State” • What about treatment ponds or lagoons?

  8. Type of NPDES Permits Wastewater Discharges Stormwater Discharges Industrial Direct Discharge Municipal Separate Storm Sewer Systems (MS4) Industrial Pretreatment Industrial Stormwater Municipal Direct Discharge Groundwater Remediation Type of Discharge/Activity Dewatering and Hydrostatic Testing Construction Stormwater Land Application of Wastewater Cooling Water Discharge Confined Animal Feeding Operations

  10. NPDES Storm Water Permits:Types, Components, and Issuance Process

  11. NPDES Storm Water Permits • Municipal Separate Storm Sewer Systems (MS4) • Municipal/Industrial Section • Industrial Storm Water • Municipal/Industrial Section • Construction Storm Water • Municipal/Industrial Section • Dewatering/Hydrostatic Testing • Municipal/Industrial Section • Confined Animal Feeding Operations (CAFO) • Livestock Section

  12. Types of NPDES Permit Coverage • Individual • 1 application submitted, 1 permit issued • General • 1 permit issued, many applications submitted • Issued on an area-wide (State, watershed, etc.) basis • Available when: • Same or similar operations • Discharge same wastes

  13. Individual Permit Issuance Process Permit Application • Permit and Fact Sheet Development • Effluent Limits • Monitoring Conditions • Standard Conditions • Special Conditions Public Notice and Public Comments Administrative Record Final Permit

  14. General Permit Issuance Process Identify Need and Collect Data • Permit and Fact Sheet Development • Effluent Limits • Monitoring Conditions • Standard Conditions • Special Conditions Public Notice and Public Comments Administrative Record Final Permit Notice of Intent to be Covered

  15. NPDES MS4 Administrative Process • MS4 permits are typically general permits • Individual when no legal authority exists • Submit notice of intent along with Storm Water Management Plan (SWMP) • NDEQ will review, may give feedback • Public notice permit and SWMP 30 days • Permit issued for 5 years

  16. NPDES MS4 SWMP Requirements • MS4 programs must work on six minimum measures over the permit term • Pollution Prevention/Good Housekeeping • Illicit Discharge Detection and Elimination • Public Education/Outreach • Public Involvement/Participation • Construction Site Storm Water Control • Post-Construction Storm Water Management • Sampling is a major component of the MS4 permits • Year-end reporting is specified also

  17. NPDES MS4 Contacts • Administrative Assistance • Receive and Send Forms, Record of Correspondence, General Information • Sharon Brunke • 441-8830 • Compliance Assistance • Receive and Send Reports, Interpretation of Permit, Education, Writes Permits • Jesse W. Poore • 441-1882 • Unit Supervisor • Approves Permits, General Guidance • Donna Luckner • 441-1367

  18. NPDES ISW Administrative Process • Industrial Storm Water (ISW) program focuses on industries with reasonable potential to cause storm water pollution • Determined by SIC code (no NAICS list yet) • Can apply for no exposure certification • General permit used almost without exception • No public notice needed for authorization • Individual permit reserved to assist in case of significant non-compliance • Authorization issued for 5 years

  19. NPDES ISW – Who’s Included 11 Industrial Categories subject to ISW permit requirements based on Descriptions / SIC numbers: i: 405-471 (except 413, 435, 437, 438, 441, 442, 444, 445, 448-454, 456, 457, 459, 460, 462, 470) Transportation ii: 24, 26, 28, 29, 311, 32, 33, 3441, 373 Product Manufacturing iii: Mineral Industry iv: Hazardous Waste – 10, 12, 13, 14… v: Landfills (RCRA may pre-empt NPDES here.) vi: Reclamation / Recycling vii: Steam Electric Plants (coal-fired, etc.) viii: Transportation – 40-45, 5171. ix: Treatment Works x: Construction xi: Light Industry - 20-23, 2434, 25, 265, 267, 27, 283, 285, 30, 31, 323, 34039, 4221, 4222, 4225. Note: if you are near 303d listed waters of the state, you may be subject to more stringent rules…

  20. NPDES ISW Requirements • Unique component is the storm water pollution prevention plan (SWPPP) • Must be in place prior to permit authorization • Must be revised to reflect current conditions • SWPPP includes: • Map including outfalls and receiving streams • Identification of potential pollutants • Best management practices (BMPs) • Employee training • Any inspections scheduled or completed • Storm event monitoring if required
