Marbury v. Madison • Under President Adams Marbury was appointed as Justice of the Peace in Washington D.C. • Jefferson appointed James Madison as his secretary of state and ordered Madison not to deliver the Marbury commission • Marbury sued Madison to get the appointment he felt he deserved and asked the court to issue a writ of mandamus requiring Madison to deliver the appointment, which was permitted under the judiciary act of 1789. • Marbury’s request for a writ of mandamus was based on a law passed by congress that the court saw as unconstitutional
Judicial Review • Power of the Supreme Court or any court to declare unconstitutional federal or state laws and other acts of government • Created an independent branch of government known as the judiciary • Chief Justice Marshall was responsible for the creation of the judicial branch of government as we know it today

Burr Conspiracy • In 1804 during a campaign Hamilton called Burr “A dangerous man, and on who ought not be trusted with the reins of government.” • Burr was offended and wanted a duel with Hamilton • Burr was charged with murder in New York and New Jersey • Burr was never convicted because he left to South Carolina and returned later to Washington D.C.
