Amendment Language Ballot Title: “Use of Marijuana for Certain Medical Conditions” • Medical use of marijuana for debilitating diseases or other conditions • Physicians issue certification for use • Caregivers may assist in medical use of marijuana • Department of Health (DOH) will register and regulate Medical Marijuana Treatment Centers

  3. Amendment Language Ballot Title: “Use of Marijuana for Certain Medical Conditions” • DOH will issue identification cards to patients • Prohibits smoking medical marijuana in public places • On-site accommodation not required

Staff Workgroup • Staff Workgroup - County Attorney’s Office, Zoning, Health Services, Drug Free Office • Gathering information from law enforcement • Reviewing County Zoning Regulations • Met with LA County District Attorney • Reviewing other local ordinances and County’s Pain Management Clinic Ordinance

Proposed Local Ordinances • City of Flagler Beach– Regulating to Medical Marijuana • Special Exception Use - Highway Commercial District • Additional Conditions and Separation Distances • Prohibited Use – Non-medical Marijuana and Cannabis Farms in all Zoning Districts • First Reading – June 12, 2014

Proposed Timeline • July 2014 - Staff work session with Board • August/September 2014 – Local Planning Agency (County P&Z) must review any ordinance for consistency with the County comprehensive plan • September/October 2014 – If applicable, ordinance will be set for two public hearings before the Board • November 4, 2014 – Citizens vote on ballot initiative

Compassionate Medical Cannabis Act “Charlotte’s Web” SB1030 - Cannabis • Patients and legal representative possess & purchase low-THC cannabis • Suffering from cancer or other medical condition produces seizures • Creates standard of care • Physicians must complete 8-hour course by FMA or FOMA • DOH will monitor physician registration & ordering low-THC cannabis • Creates penalties – 1st degree misdemeanor

Compassionate Use Registry • DOH will create registry by Jan 2015 • Access by physicians, law enforcement and dispensers • Physicians responsible for registering patients • Dispensers must check registry before dispensing low-THC cannabis • Dispensers must update the registry after dispensing to patient

  11. Dispensing Organizations • DOH will authorize five dispensing organizations - Jan 1, 2015 • Cultivate, process and dispense low-THC cannabis • Nurseries registered with Department of Agriculture and been in business 30 years • All owners, managers, staff fingerprinted & pass Level 2 background screening • Licensed Physician serves as Medical Director • Financial requirements • Approximately 39 registered nurseries
