Implied Powers- not stated but understood to be granted • “Necessary and Proper” Clause • Elastic Clause-Clause 18 • 4. Categories of Lawmaking Powers: • Money • Commerce • Military • Foreign Policy • 5. Power to impose taxes and coin money • 6. Regulates commerce (transactions) that take place across state lines • 7. Congress can create/ maintain armed forces and declare war • 8. Create postal service and federal court system • 9. Set up gov’t in Washington D.C.
Nonlegislative Powers • 10. Nonlegislative Powers: • Suggest amendments • Approve/Reject nominees of Supreme Court, Federal judges, and ambassadors • House can impeach- accuse officials of misconduct in office • Bill Clinton (1998) • Andrew Johnson (1868)
Limits on Congressional Powers • 11 Bill of rights limits powers of federal gov’t • 12. Congress can NOT: • Writ of habeas corpus • Bills of attainder • Ex Post Facto Laws • Regulate state/branches • 13. Writ of habeas corpus- requires police to bring prisoners to court and explain charges • 14. Bills of attainder- impose punishment without trial • 15. Ex Post Facto Laws- declares an act as a crime after it has been committed • 16. Congressional limitations are placed on issues reserved for the state or other branches
