Modified or special activities • If these four criteria are met • Programs and activities operate within the most normal and appropriate setting • Qualified students with disabilities are not denied opportunity to participate in programs and activities that are not separate and different • Qualified students with disabilities are able to participate in one or more regular programs and activities • Students with disabilities are appropriately placed in full-time special facilities.

  9. Jeffery Kling Case • IEP team is charged with the responsibility to determine the need for students with disabilities to participate in interscholastic sport. (Not the Ohio High School Athletic Association - OHSAA) • Any conflict between state rules are ruled in favor of the connection with IDEA.
