Davis v. Happyland Toy Company • Civil Case: plaintiff has the burden of proof • must prove defendant guilty beyond preponderance of the evidence • Here is a synopsis of the 2010-11 national case problem, which will be released by August 15: A young child swallowed several dozen beads from his older sister’s make-your-own jewelry set. His babysitter found him lying on the carpet minutes later and hurried him to the hospital. The boy died shortly after. Tests revealed that the beads he swallowed contained 1,4-butanediol, a precursor for a controlled substance called gamma-Hydroxybutyric acid (“GHB”). The boy’s parent has brought a civil lawsuit for negligence and strict liability against the toy company that designed and manufactured the jewelry set that allegedly caused the boy’s death.

Time Limits • Opening Statement-5 minutes per side • Direct Examination of all three witnesses (combined)-25 minutes per side • Cross Examinations of all three witnesses (combined)-25 minutes per side • Closing Argument-9 minutes per side • Plaintiff/Prosecution Rebuttal-may reserve up to 5 minutes for rebuttal, but must request this before commencing closing argument.
Role of Attorney • Listen to everything • Able to use notes • Responsible for objecting to opponents examinations • conduct at least one direct/cross examination • must ask more than one question* • Only attorney responsible for witness may object • May give an open or close, but not both • Attorneys may request permission to consult with co-counsel
Role of Witness • Recall testimony and answer questions by attorneys • Acting the part of the witness can make the audience engaged • Unable to use notes on witness stand • Essential part of case • Make the story come to life • Respond only to questions asked-direct • Listen carefully to opposing counsel, don’t concede-cross
Role of Timekeeper • officer of the court while keeping time during a trial • accurately monitor the time elapsed • unobtrusively indicate to her/his team the amount of used or remaining time • announce aloud to the court when the time for any part of the trial has expired • Keep record of official time and bring timekeeping sheets • Time responding to judge/argument is untimed • If team runs out of time on examination, receive no points for examination (attorney/witness)
Scoring • Attorneys receive a score of 1-10 based on performance • Witnesses receive a score of 1-10 based on performance • Scoring begins when trial starts/ends when it’s over • Judges ruling has no outcome of the overall winner for the round
