    4. Why ITAR is Important Keeps defense articles out of the hands of those that pose a threat to the U.S. Protects U.S. Intellectual Property Failure to comply with ITAR can result in lofty fines and possibly imprisonment

    5. Defense Articles Any item or technical data designated in the Munitions list of ITAR. This term includes technical data recorded or stored in any physical form, models, mockups or other items that reveal technical data directly relating to items designated on the Munitions list. Does not include basic marketing information on function or purpose of general system descriptions.

    6. Technical Data Information other than software, which is required for the design, development, production, manufacture, assembly, operation, repair, testing, maintenance or modification of defense articles. This includes information in the form of blueprints, drawings, photographs, plans, instructions or documentation. Classified information relating to defense articles and defense services Information covered by an invention secrecy order Software as defined in End-items, components, accessories, attachments, parts, firmware, software and systems portion of the munitions list directly related to defense articles

Technical Data Technical data does not include information concerning general scientific, mathematical or engineering principles commonly taught in schools, colleges and universities or information in the public domain. It also does not include basic marketing information on function or purpose of general system descriptions of defense articles.

    8. U.S. Munitions List The U.S. Munitions List outlines what types of items are covered by ITAR. U.S. Munitions List Firearms, Close Assault Weapons, & Combat Shotguns Guns & Armament Ammunition/Ordnance Launch Vehicles, Guided Missiles, Ballistic Missiles, Rockets, Torpedoes, Bombs, & Mines Explosives and Energetic Materials, Propellants, Incendiary agents, & their Constituents Vessels of War & Special Naval Equipment Tanks & Military Vehicles Aircraft & Associated Equipment Military Training Equipment & Training Protective Personnel Equipment & Shelters Military Electronics Fire Control, Range Finder, Optical & Guidance, & Control Equipment Auxiliary Military Equipment Toxicological Agents, Including Chemical Agents, Biological Agents, & Associated Equipment Spacecraft Systems & Associated Equipment

    10. U.S. Munitions List Nuclear Weapons, Design & Testing Related Items Classified Articles, Technical Data, & Defense Services Directed Energy Weapons Submersible Vessels, Oceanographic & Associated Equipment Miscellaneous Articles

    11. U.S. Munitions List Miscellaneous Articles. Any item that has significant military use, whether or not it was specifically designed for that purpose The Director of the Office of Defense Trade Controls will make the distinction of whether an Item is a Miscellaneous Articles

    12. Not Covered By ITAR Public Domain Fundamental Research

Public Domain Information which is published and is generally accessible or available to the Public Sales at Newsstands & bookstores Subscriptions which are available without restriction Second class mailing privileges Libraries open to the public Patents available at any patent office Public release in any form Fundamental research

Fundamental Research Basic and applied research in Science and Engineering where resulting information is ordinarily published and shared broadly within the scientific community, as distinguished from research, the results of which, are restricted for proprietary reason or specific U.S. Government access and dissemination controls.

    15. Fundamental Research University Research will not be considered Fundamental if: The University or Researchers accept restrictions on publication of information resulting from the project or activity The research is funded by the U.S. government and specific access and dissemination controls protecting information from the research are applicable

    16. What Does it Mean For You? You may share general scientific, mathematical and engineering principles, and basic marketing information on function or purpose of defense articles. Stay away from specifics concerning technical data Don’t share technical data with anyone, unless they have a need to know and an exception has been granted. Never make assumptions about exceptions Check that all necessary exceptions have been granted before sharing information

    17. What Does it Mean For You? Casual conversations about technical data outside the conference are deemed exports. Exceptions are required for these conversations You will be held responsible for the leak of information If you illegally share any information you will face fines of up to $1,000,000 per violation, or up to 10 years imprisonment, or both.
