Background Info Scott was a slave that in resided in Illinois from 1833-1843. Slavery was forbidden in the Louisiana Territory due to the Missouri Compromise, so Scott sued for his freedom. Issue Was Dred Scott a free man or a slave? Decision A black man was not considered a citizen under the Constitution so Scott lost the lawsuit and the Missouri was found unconstitutional.
