3. Term Paper Requirements • Title: if you are not sure…. ask • Nature of the Case: MUST include 1) what type of case, 2) how the case went from lower court to Supreme Court, and 3) the relief sought • Holding / Concurrence / Dissent: include who wrote the opinion and their reasoning • Formatting: margins, indentations, categories in bold, page limits

4. Using Legal Jargon • “Writ of Certiorari” • “Declaratory Ruling” • “Deference” • “Statutory Authority” • Rule of Thumb: Look up the definition, and put the term or phrase in your OWN words

5. Using Quotes from the Case • Instead of using several quotes from the case, try to put the material in your OWN words • If you have any “quotation marks,” those NEED to be followed by case citations • Cite the case by referencing the page number of the majority, concurring or dissenting opinion • Secondary sources are okay, as long as you CITE them

6. Grammar • Know the difference between it’s and its • Its = possessive • It’s = it is • Make sure you are using the appropriate pronouns • Ex: The FCC overstepped its bounds • Ex: The Justices issued their opinions • DO NOT use contractions in formal or academic writing • Avoid passive voice • Ex: was authorized by Congress >> Congress authorized
