2. What’s new? • DMVs across the country are implementing an FMCSA rule that dates back to 12/2008. Rule resulted from requirements of the Motor Carrier Safety Improvement Act of 1999. • CMV drivers are required to provide a copy of their medical examiner’s certificate to their state licensing agency. • State licensing agencies are required to share medical examiners certificate with Commercial Driver License Information System (CDLIS). • A national registry of certified medical examiner’s is envisioned.

3. What do Oregon CDL holders have to do? • Provide to the Oregon Driver and Motor Vehicle Services Division (DMV) a copy of their medical examiner’s certificate by January 30, 2014. • Those who renew or replace their CDL before 2014 provide a copy of their medical card at the time of renewal or replacement. • Those who aren’t due to renew their license by 2014 will be notified in a staggered process over the next two years and asked to provide a copy of their medical card.

4. CDL holders must certify a driving type • Non-Excepted Interstate – You are an Interstate driver and must meet the Federal DOT medical card requirements. • Excepted-Interstate –You are an Interstate excepted driver and do not have to meet the Federal DOT medical card and certain other requirements. • Non-Excepted Intrastate –You are an Intrastate non-excepted driver and are required to meet the medical requirements for your State.

5. Examples of Excepted Interstate • School bus operations • Transportation performed by the government • Occasional transport of personal property not for compensation nor for a commercial enterprise • Transportation of human corpses or sick & injured persons • Emergency delivery of propane winter heating fuel and pipeline response • Farm custom operations (custom harvesters) • Operation of a vehicle by a beekeeper engaged in seasonal transportation of bees • Non-articulated farm vehicle operation within 150 miles of the farm

7. Important notes! • Ensure that the name and license number on the medical certificate are legible. If it’s hard to read, drivers should include a copy of the front of the CDL or write the driver’s name and license number legibly on a separate piece of paper included in the mailing, e-mail, or fax. • DMV needs a copy of the medical examiner’s certificate. It is not accepting the Medical Examination Report for Commercial Driver Fitness Determination, which is called the “long form.” That form does not include specific information from the medical card that DMV needs to comply with federal law.

8. What are the consequences if a driver fails to provides a medical card? • If a driver fails to meet the requirement, DMV will send a notice that it intends to cancel the driver’s CDL and the cancellation is effective 30 days after the notice is mailed. • Drivers who don’t want to meet the requirement have the option, of course, to just surrender their commercial driving privileges at a DMV field office. And currently there’s no fee to issue a replacement license without commercial privileges if a driver is downgrading.

9. What happens to drivers who have • their CDL canceled? • If a CDL is canceled for not maintaining a current medical card with DMV, the driver will have three years from the cancellation date, or three years from the date a driver drops the CDL, whichever is earliest, to get another CDL without retesting. • If a CDL is canceled for failing to submit a copy of the medical card, the driver can still operate a non-commercial vehicle if the non-commercial privileges are not expired, revoked, suspended or canceled under a separate action.
