The Ombudsman Program • Authority under the Federal Older Americans Act • Office of the State LTC Ombudsman in every state • Access to all LTC facilities without interference • Access to residents and records (HIPAA exempt) • Part of the Elder Rights System under Title VII • Responsibilities of a Long-Term Care Ombudsman • Investigate & Resolve Complaints • Educate consumers/providers on residents’ rights • Advocate for quality care in LTC facilities • Promote development of resident/family councils NYSLTCOP 2010
