What is significant caregiver responsibility? • Pervasive day-to-day care; child views caregiver as one of the primary persons with the authority for their care and person is expected to remain part of family • Other household member has become a parent figure to the child. • Observations • Child statements • Other family member statements CPI Case Practice Lab 1.1.5

Household Definition • Is a common residence shared by two or more individuals whether related or not, and • Includes additional relatives or persons residing in or frequenting the home, including visitors expected to stay an indefinite length of time or college students expected to return to the home.” CPI Case Practice Lab 1.1.6

Multiple Families in Household The family unit that the alleged maltreatment occurred in will be the focus of the FFA when: • The families clearly function independently from each other. • The two families may share some or all of the household expenses but do not have access to or combine family incomes. • The children in each family do not view the parent(s) in the other family unit as having any responsibility or authority over their care. • Some child care duties may be shared on occasion. Rechecks After commencement of the investigation CPIs are able to submit requests to the Hotline CIU for records to be used for investigative purposes: • Subjects’ name and/or demographics not known at time of intake • Additional persons in intake household identified CPI Case Practice Lab 1.1.12

Uses of NCIC/FCIC/DAVID Information Obtained for Investigation For investigative purposes only: • “Purpose Code C” Florida Rap Sheet with Sealed/Expunged(if any) and NCIC National Rap Sheet Information. • May only be disseminated to Department Child Protective Investigation and CLS staff • May not be disseminated to case management and/or contract providers CPI Case Practice Lab 1.1.13

Uses of NCIC/FCIC/DAVID Information Obtained for Investigation, Continued • “Purpose Code Q” Florida Rap Sheet with no Sealed/Expunged information and NCIC Information. • May be disseminated to Department Child Protective Investigation and CLS staff • May be shared with approved criminal justice agency • May be disseminated to case management and/or contract providers during case transfer. FSFN Criminal History Documents • Criminal History Record Information provided by the Hotline CIU will be available via FSFN for 72 hours from the time the criminal history check was completed. • The FSFN Q and J documents can be printed. • The FSFN C and N documents cannot be printed. Improper Uses of NCIC/FCIC/DAVID • CPI submitting a request for purposes of Adoptions, Foster Care Licensing, Respite Care provider or Judicial Review • Querying systems for anything other than investigations assigned (e.g. friend or family member, celebrity, etc.) • Copying the information to keep in record • Sharing information with any person not authorized CPI Case Practice Lab 1.1.16

  17. Proper Documentation of Record Checks “The appropriate background checks were conducted on (date) for (individual’s name). CPI has evaluated the information and reviewed for patterns of behavior or domestic violence that may pose potential safety concern or elevated risk of maltreatment to a child. At this time, (there appears to be) or (there does not appear to be) an immediate negative impact on the victim’s safety.” CPI Case Practice Lab 1.1.17

  18. What information and record types can CPI access for relative/non-relative placement related responsibilities? For assessment of persons in potential contact with children or caregiving responsibility: • “Purpose Code Q” FCIC (Florida Rap Sheet w/out Sealed/Expunged) • “Purpose Code X” NCIC Information • NCIC, FCIC, DHSMV record information obtained for an investigation may not be used for related responsibilities CPI Case Practice Lab 1.1.18

Facts about Rap Sheets • Florida and National Rap Sheets are similar • States may vary on the type of info provided and dispositions can be missing. • To obtain a missing disposition the arresting agency or appropriate Clerk of the Court may need to be contacted. • Rap Sheets normally contain: • Type of Offense and Date • Personally Identifiable Information (PII) • Arresting Agency and Court • Disposition CPI Case Practice Lab 1.1.20

  21. “Hot Files” Person Files Files on persons to include Wanted, Missing Person, and Unidentified Person files. Status Files Are for informational purposes and include: Sexual Offender/Predator File, High Risk Sex Offender File, Probation or Supervised Release File, Career Offender File, Writs of Bodily Attachment, and Protection Orders. Criminal History Related Documentation in FFA Based on review of criminal history information, there is a pattern of: • Aggressive and violent acts towards intimate partners (or children, or family members, etc.) • Substance use that has resulted in legal consequences • Criminal behaviors and charges resulting in incarcerations • A pattern of behavior that is increasing in frequency and severity CPI Case Practice Lab 1.1.22
