Legal Basis • Founded in May 2005 as a limited liability company • Non-profit organisation • Issued by the Federal Ministry of Agriculture, Forestry, Environment and Water Management entrusted with tasks defined in: • Waste Management Act (AWG) 2002 • WEEE Ordinance • Battery Ordinance

New Challenges in thefuture • New methodology for the collection rate • 2016: 45 % of the average POM-masses of the last three years • 2019: 65 % of the average POM-masses of the last three years “OR” • 85 % of WEEE generated (UNU-codes) • Reporting of large appliances is essential • Currently the collection rate is 25 % 58 % necessary to meet the requirements • Private transfer • Collection and treatment with scrap iron • Disclosure to informal collectors export and loss of resources • Long life cycle
Re-Use • Additional tasks for operators of municipal collection points • Separation of re-use devices • Own preparation for re-use or disclosure to socio-economic companies (at least 2 times a year) • Requirements for re-use operators • Permit referred to Waste Management Act 2002 • Appropriate infrastructure • Qualified staff for inspection, repair and maintenance of re-use products • Reporting
New Regulationssince 1. January 2016 • Obligation to designate an “Authorized Representative” (AS) in the recipient country to fulfil producer responsibility • Improving the financing of POM-masses sold by e-commerce • natural or legal person in the MS • Delivery address in the MS • Administrative responsibility • Equipped with power of attorney • Registration (person and producer/importer) • Obligated for Austrian companies also in destination countries of their products
