  4. Summary • Morgan had LASIK eye surgery performed by Dr. Nevyas. Morgan was left blind after the surgery. Morgan sued for malpractice and made a website about LASIK. Nevyas threatened to sue if she did not remove the libelous material from the website. Yahoo removed the website and then Morgan moved the website to a different server with different comments. Nevyas sued for breech of contract for failing to remove the negative comments.

  5. Decision • The case was vacated and remanded. The job of the trial court was to determine if the new website contains any libelous material that would then violate the agreement with Nevyas.
