  2. Recount Procedure • 300. (1) If the difference between the number of votes cast for the candidate with the most votes and the number cast for any other candidate is less than 1/1000 of the votes cast, the returning officer shall make a request to a judge for a recount within four days after the results are validated.

  3. Recount Procedure • Can make an application:      301. (1) An elector may, within four days after the date on which a returning officer issues a certificate under section 297, apply to a judge for a recount.

  4. Recount Procedure • s. 301 (2) The judge shall fix a date for a recount if it appears, on the affidavit of a credible witness, that (a) a deputy returning officer has incorrectly counted or rejected any ballots, or has written an incorrect number on the statement of the vote for the votes cast for a candidate; or (b) the returning officer has incorrectly added up the results set out in the statements of the vote.

  5. Recount Procedure 300. (1) If the difference between the number of votes cast for the candidate with the most votes and the number cast for any other candidate is less than 100 votes or is greater than the total amount of rejected ballots, the returning officer shall make a request to a judge for a recount within four days after the results are validated.

National List of Electors • Please check the "Yes" box on page 1 of your return if you are a Canadian citizen and you want to authorize the Canada Revenue Agency (CRA) to provide your name, address, and date of birth to Elections Canada. Elections Canada will use this information to make sure that the National Register of Electors is kept up to date. Your authorization is needed every year, whether your information has changed or not. • Please check the "No" box on page 1 of your return if you do NOT authorize the Canada Revenue Agency (CRA) to provide your name, address and date of birth to Elections Canada.

  9. Private Right of Action • 511. (1) If the Commissioner believes on reasonable grounds that an offence under this Act has been committed and is of the view that the public interest justifies it, the Commissioner may institute a prosecution or cause one to be instituted.

  10. 512. (1) No prosecution for an offence under this Act may be instituted by a person other than the Commissioner without the Commissioner’s prior written consent.

  11. Private Right of Action 331. No person who does not reside in Canada shall, during an election period, in any way induce electors to vote or refrain from voting or vote or refrain from voting for a particular candidate unless the person is (a) a Canadian citizen; or (b) a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act.
