Transmittal 534 • Summary of Changes: The purpose of this Change Request is to allow the MACs and ZPICs the discretion to deny claims that are "related” and submitted before or after the claim in question • Implementation Date: September 8, 2014 • If documentation associated with one claim can be used to validate another claim, those claims may be considered “related”
“Related Claims” • Approved examples of “related” claims that may be denied as “related”: • Post-Payment Review of Part B services • Attending Physician • Surgeon • For IP to Observation • MAC reviews the hospital record • Determines the physician service was reasonable and necessary • Physician’s claim will be changed to the appropriate outpatient evaluation and management service • When documentation does not support the medical necessity for performing a procedure • MAC will totally deny the performing physician’s Part B claim
Documentation • MACs, CERTS, Recovery Auditors and ZPICS may request Additional Documentation during prepayment and post-payment review • Mayissue an Additional Documentation Request (ADR) • The term ADR refers to all documentation requests associated with prepayment review and post-payment review • Auditors should request additional information to ensure they are not recouping inappropriately
More Documentation • The CERT contractor will only request documentation within its Statement of Work • Physician & Provider Documentation Includes, but is not limited to: • Clinical & Physician evaluations • Physician office records • Nursing Home and Home Health Agency records • Supplier/lab/ambulance notes • Other documents needed from a biller in order to conduct a review and reach a conclusion about the claim
MAC & ZPIC • The MAC shall report to reviewing agencies prior to initiating denial of “related” claims situations • The MAC and ZPIC shall await CMS approval prior to initiating requested “related” claim(s) review. Upon CMS approval, the MAC shall post the intent to conduct “related” claim review(s) to their Web site within 1 month of initiation • The MAC shall inform CMS of the implementation date of the “related” claim review 1 month prior to the implementation date
Auditors • If “related” claims are denied automatically, MACs shall count these denials as automated review. If the “related” claims are denied after manual intervention, MACs shall count these denials as routine review. • The Recovery Auditor shall utilize the review approval process as outlined in their SOW when performing reviews of “related” claims. • The MAC, Recovery Auditor, and ZPIC are not required to request additional documentation for the “related” claims before issuing a denial for the “related” claims. • Contactors shall process appeals of the “related” claim(s) separately.
Authority to Collect Documentation • Social Security Act. Section 1833(e) states • “No payment shall be made to any provider of services or other person under this part unless there has been furnished such information as may be necessary in order to determine the amounts due such provider or other person under this part for the period with respect to which the amounts are being paid or for any prior period.” • Section 1815(a) states • “…no such payments shall be made to any provider unless it has furnished such information as the Secretary may request in order to determine the amounts due such provider under this part for the period with respect to which the amounts are being paid or any prior period.”
Time Frames • Upon receipt of unsolicited documentation: • Contractor has 60 days to make a determination on the claim • May request ADR through “normal business procedures” • Allows 45 days for receipt of documentation • Mustmake a determination within 60 days of receipt the last piece of documentation
