  2. HOW DO WE DEFINE EACH FUNDRAISER: THE ORGANIZED ACTIVITY SOCIAL FUNCTION HELD FOR RAISING FUNDS. ARTICLE 15 – SOURCE OF INCOME (PG. 68). CONSTITUTION & BY-LAWS: A LAW OR RULE GOVERNING THE INTERNAL AFFAIRS OF AN ORGANIZATION. CONSTITUTION BY-LAWS (C&BL), AND REGULATIONS OF THE DISABLED AMERICAN VETERANS DEPARTMENT OF ALABAMA SECTION 4.9: CHAPTER FUND RAISING (PG. 8-9).

FUNDRAISING WHEN TALKING FUNDRAISING, WE HAVE TO TALK CONSTITUTION & BY-LAWS (C&BL), WE CANNOT DO FUND RAISING WITHOUT A CLEAR UNDERSTANDING OF THE GUIDELINES WE HAVE TO FOLLOW AS AN ORGANIZATION. WE MUST STAY WITHIN GUIDELINES TO STAY OUT OF TROUBLE AT THE NATIONAL, DEPARTMENT, DISTRICT AND CHAPTER LEVELS.

  4. ARTICLE 15 – SOURCE IF INCOME NATIONAL ORGANIZATION REVENUE IS DERIVED FROM: • DUES • CONTRIBUTIONS AND SUCH OTHER SOURCES AS MAY BE APPROVED BY THE NATIONAL EXCUTIVE COMMITTEE (NEC). STATE DEPARTMENT REVENUE IS DERIVED FROM: • DUES • CONTRIBUTION AND SUCH OTHER SOURCES AS MAY BE APPROVED BY THE NATIONAL EXCUTIVE COMMITTEE (NEC). NOT LESS THAN TEN DAYS PRIOR TO REQUESTING APPROVAL OF THE NEC TO CONDUCT ANY FUND RAISING PROJECT OR ACTIVITY WITHIN TERRITORY OF ANY ONE OR MORE CHAPTERS. • STATE DEPARTMENTS HAVE TO NOTIFY ALL CHAPTERS OF INTENTION • IF CHAPTERS OPPOSE, THEY HAVE TO FILE IMMEDIATELY TO THE NEC. NO STATE DEPARTMENT FUND-RAISING PROJECTS, WHICH ARE TO BE CONDUCTED IN AN AREA GOVERNED BY ANY OTHER STATE DEPARTMENT, SHALL BE APPROVED BY THE NEC.

  5. CHAPTERS, DAV AUXILIARIES, AND NOTR (SEC. 15.3) REVENUES DERIVED FROM: • DUES, • CONTRIBUTIONS AND SUCH OTHER SOURCES AS MAY BE APPROVED BY THE STATE DEPARTMENT WITHIN WHICH THE SAME IS LOCATED. DON’T NEED PRIOR APPROVAL WHERE THE GROSS RECEIPTS IS LESS THAN $5,000.00, BUT ADVANCE NOTICE TO STATE DEPARTMENT IS REQUIRED. • WHERE NO COMMISSIONS ARE TO BE PAID • SOLICITATION OF FUNDS SHALL BE ONLYBY PERSONAL CONTACT OF MEMBER AND FRIEND OF MEMBER. • NOTICE HAS TO BE IN 30 DAYS BEFORE THE FUND-RAISING PROJECT. • FUNDRAISING MUST BE IN COMPLIANCE WITH FEDERAL, STATE, AND LOCAL LAWS. • ALL MONIES RECEIVED BY LOCAL CHAPTERS ON FUND-RAISING ACTIVITIES, SHALL BE RETAINED BY CHAPTERS, EXCEPT THAT PORTION THAT IS REQUIRED TO BE PAID TO THE STATE DEPARTMENT BY LAW. IF NO STATE DEPARTMENT, APPROVAL TO CONDUCT FUNDRAISER MUST BE OBTAINED FROM THE NEC.

  6. CITY OR LOCATION WHERE THERE IS MORE THAN ONE CHAPTER CHAPTER SHALL ADVISE ALL OTHER CHAPTERS IN THE CITY OF INTENT • TO REQUEST APPROVAL OR • INTENT TO NOTIFY IN THE EVENT LESS THAN $5,000.00 IN GROSS RECEIPTS CHAPTER OPPOSING SHALL IMMEDIATELY FILE OBJECTION • TO STATE DEPARTMENT OR • IF NO STATE DEPARTMENT, CHAPTERS SHALL FILE WITH NEC NO CHAPTER OR ITS AUXILIARY SHALL CONDUCT FUND-RAISING DRIVES IN THE TERRITORY OF ANY OTHER CHAPTER, UNLESS APPROVED BY THE CHAPTER IS FIRST RECEIVED EXCEPTION TO THE RULE: IF MAJORITY OF CHAPTERS WANT TO CONDUCT A CITY AND/OR COUNTY WIDE FUND-RAISING PROJECT WITHOUT CONCURRENCE OF THE MINORITY OF THE CHAPTERS, • PRIOR APPROVAL MUST BE OBTAINED FROM STATE DEPARTMENT,OR • IF NO STATE DEPARTMENT, APPROVAL MUST COME FROM THE NEC

  7. FORGET-ME-NOT DRIVE ANY CHAPTER AND ANY DAV AUXILIARY UNIT, WITH ITS CHAPTERS PRIOR CONSENT MAY CONDUCT ONE ANNUAL FORGET-ME-NOT DRIVE. • SOLELY FORGET-ME-NOT FLOWERS PURCHASED FROM NATIONAL HEADQUARTERS • NO PAID PROMOTER INVOLVED, UNLESS PRIOR APPROVAL IS EXPRESSLY REQUIRED BY THIS SECTION 13.3: PARA 5. CHAPTER AND DAV AUXILIARY UNIT SHALL ADVISE THE STATE DEPARTMENT BEFORE THE DATE OF EACH ANNUAL FORGET-ME-NOT DRIVE. FORGET-ME-NOT DRIVES SHALL NOT EXCEED SEVEN CONSECUTIVE DAYS, WITHOUT THE CONSENT OF THE STATE DEPARTMENT. ANY STATE DEPARTMENT MAY CONDUCT A FORGET-ME-NOT DRIVE WITHIN THE STATE, IN CITIES OR COUNTIES WHERE THERE IS NO CHAPTER. THEY DON’T HAVE TO HAVE PRIOR APPROVAL FROM THE NEC.

  8. MEMBERS AND SOLICITING FUNDS NO MEMBER CAN SOLICIT FUNDS OR OFFER FOR SALE ANY FORM OR KIND OF MERCHANDISE OR SERVICE AS A DISABLED VETERAN, OR IN THE NAME OF THE DAV, OR WHILE WEARING ANY PORTION OF THE DAV UNIFORM, EXCEPT • WITH APPROVAL OF THE CHAPTER(S) AND • OF THAT STATE DEPARTMENT NO MEMBER OF THE DISABLED AMERICAN VETERANS SHALL DIRECTLY OR INDIRECTLY • RECEIVE • ACCEPT • SOLICIT • CONTRACT FOR • OR CHARGE ANYTHING TO THAT EFFECT TO A VETERAN OR THEIR DEPENDENTS FOR SERVICE THEY ARE ENTITLED TO UNDER THE LAW AS VETERANS OR DEPENDENTS OF VETERANS LIVING OR DECEASED.

  9. DIRECT OR INDIRECT CONTRACTS FUND-RAISING PROJECTS THAT INVOLVE DIRECT OR INDIRECT CONTRACTS OF ANY NATURE ARE REQUIRED TO: • OBTAIN PRIOR APPROVAL FROM THE STATE DEPARTMENT AND NEC. • CONTRACT MUST ALLOW 60 DAYS FROM THE DATE OF SUBMITTAL UNTIL THE PROPOSED COMMENCEMENT DATE OF CONTRACT TO GIVE NEC PROPER TIME FOR CONSIDERATION.

THRIFT STORE EFFECTIVE AUGUST 1, 1989 ALL NEW THRIFT STORES OPERATION REQUIRE: • WRITTEN MANAGEMENT CONTRACT BY THE STATE DEPARTMENT IN THE STATE OF ACTIVITY. • THRIFT STORES EXISTING PRIOR TO AUGUST 1, 1989 MAY RENEW IN ACCORDANCE WITH THESE BYLAWS, AND CONTRACT MUST BE CONSISTENT WITH THE BYLAWS AND REGULATIONS OF THE NEC.

  11. INCOME FROM FUND-RAISING PROJECTS FUNDS ARE REQUIRED TO BE DEVOTED, WITHIN A REASONABLE TIME FOR THE PROGRAM/S IT WAS INTENDED

  12. CONTRACT APPROVAL BY NEC THE NEC SHALL NOT APPROVE A CONTRACT IN WHICH ADMINISTRATION AND COST OF FUND-RAISING EXCEED PERCENTAGES ESTABLISHED AS GUIDELINES BY ACCEPTED FEDERAL, STATE, ADVISORY AND/OR OTHER REGULATORY AGENCIES, EXCEPT FOR CONTRACTS THE NATURE OF WHICH DO NOT LEND THEMSELVES TO AN ASSESSMENT OF PROMOTIONAL OR FUND-RAISING COST.

  13. THE REFERENCES THAT GUIDE OUR ACTIONS NATIONAL CONSTITUTION BYLAWS & REGULATIONS CONSTITUTION, BYLAWS, AND REGULATIONS OF THE DISABLED AMERICAN VETERANS DEPARTMENT OF ALABAMA
