Legislative Processes • Complex and multi-layered • Highly formalized legal procedure vs. • Informal political decision-making process (semi-structured or negotiation process) • Interaction of political and legal layers • “A business process is a collection of activities that takes one or more kinds of inputs and creates an output that is of value to the customer” (Hammer & Champy) • Substantive vs. procedural value (“legitimization by procedure”)
IT support for legislative processes • Information management: descriptive modelling (reduction of complexity) • Workflow management: descriptive/prescriptive modelling (complex legal and administrative procedure: e.g., Austrian Parliament: > 1000 different types of procedural steps) • Prescriptive modelling/process re-engineering (feedback circle technical support – procedural setting): • Improving the procedural quality (efficiency, transparency) • Improving the output quality (format, content) • Improving the participatory quality (interaction with civil society)

Best practice and standardisation • Austrian „E-Law“ system typical for „first wave“ of electronic law-making support systems: in-house development, tailored isolated application • „Second wave“: adaptable standard solutions available (advantages: based on comparative problem analysis, adaptability/scalability, interoperability, cost efficiency) • Elementary reference model based on Austrian best practice case (Hoffmann/Schefbeck) • Purposes: producing, transporting, processing, documenting, publishing, and storing legislative documents • Three core elements: legislative editor, workflow system, open archive
