A visual symbol like a word signature, name, device, label, numerals or combination of colors used by owners of the trademark for goods or services or other articles of commerce to distinguish it from other similar goods or services originating from different businesses.

  3. A trademark may be designed by the following symbols, -(™), for an Unregistered Trademark, that is a mark used to promote or brand goods. - (℠), for an Unregistered service mark, that is a mark used to promote or brand services. - (®), for a Registered Trademark.

  4. Example of Trademarks, Coca Cola and Pepsi are two trademarks from the same industry(beverages) which distinctly identifies the source of origin of the goods as well as an indication of quality.

  5. Functions of a Trademark -It identifies goods or services and their origin. -It guarantees its unchanged quality. -It advertises the goods or services. -It creates an image for the goods and services.
