Main Benefits For ANSPs • Increased capacity (decreased controller workload per aircraft) • Cost avoidance compared to traditional means of increasing capacity • More efficient Controllers • Avoids the need for the introduction of new sectors • 11% increase by CPDLC is 10 times cheaper than traditional means For Airlines • Increased airspace capacity • Efficiency gains translate into lower unit rates • The CPDLC avionics package also brings • Support for AOC services via AOA/VDLM2 and/or ACARS • Legacy Airport services via AOA/VDLM2 and/or ACARS (DCL, D-ATIS, DSC)

SES Implementing Rule • The Commission, on the advice of the SESC, give a Mandate to EUROCONTROL for the development of an Implementing Rule for Datalink Services on 30th May 2005 • The Implementing Rule will be directly legally binding on all parties (not just via the State) • IR could be expected Sept 2006 after extensive consultation • Consultation process in two parts • On Regulatory Approach • The Rule Text

  9. Conclusion • LINK implementation is well underway • The extra Capacity is required, essential to implement in time • LINK provides the infrastructure for future datalink enhancements • E.g. CASCADE programme • LINK is seen as a necessary step towards SESAME http://www.eurocontrol.int/link2000

Co-operation with JAA and EASA • Uncertain regulatory situation caused by lack of clarity in work distribution between JAA and EASA • Strategy to resolve the issue: • Establish closer contact with both organizations on both management and working level • Clarify work distribution • Offer support in the form of producing draft material to overcome workload issues • Follow up each process of interest and attend meetings • High level contact made • First working level meeting with EASA successful • Meeting with JAA to take place on 13 June (delayed to 1st week July) • Attendance of additional experts at meetings (OST, CNS/ATM SG, etc.) secured

Data Link Recording - 1 • Following AEA and EUROCONTROL intervention, new data recording proposal from FRSG rejected • JAA tends to see solution in going back to ICAO • ICAO appears to be more “commercial” minded • Request to review Annex 6 possibly more effective now • JAA is ready to launch request but they need good arguments

Data Link Recording - 2 • ICAO review process may take several years • In the meantime, Annex 6 provisions remain in effect, uncertainty of outcome possible showstopper • Strategy proposed to JAA • Publish regulation with new, agreed dates for new aircraft • Publish non-application of retrofit requirement pending the review process • Approach ICAO with powerful arguments • JAA OST has agreed this strategy • Draft rule text will be produced for approval (will be coordinated with all stakeholders, including AESA) • Arguments for ICAO approach will also be produced to be used by JAA • JAA will take action asap to publish rule and approach ICAO

Operational Approval - 1 • EASA confirmed that NPA 20-11 (Version C) will be submitted for internal review in June • JAA will comment on the Operational Approval section (EUROCONTROL will assist in developing new text) • This NPA will be published for comment as one in a set of EASA NPAs. Comment period is 3 months, but may be reduced to 6 weeks • After the comment period, EASA has 3 months to process comments and to publish them (may be longer due to workload constraints) • After responses to the comments are published a grace period of 2 months follows before publication of final rule

Operational Approval - 2 • EASA accepts EUROCONTROL’s arguments asking for publication of final rule asap • EUROCONTROL may be asked to assist in evaluating the comments to speed things up • EASA will consider processing NPA 20-11 independently of the other NPAs if this leads to earlier results • Based on the discussions with EASA, EUROCONTROL will produce a complete description of how an NPA is produced, what organisations, elements, processes and instruments are involved and produce two concrete examples covering STC and manufacturer forward fit scenarios
