Emergency Shutdown Furlough • No operating funds / lapsed appropriations • Must shut down all non-essential operations • Little or no lead time to plan or notify technicians
Excepted Activities • Activities that may be excepted are: • P- Protection of Life and Property / National Security • S- Safety of Person and Protection of Property • M- Medical / Dental Care • A- Acquisition and Logistic Support • T- Education and Training • L- Legal Activities • I- Audit and Investigation Community • R- Morale Welfare & Recreation / Nonappropriated Funds • F- Financial Management • W- Working Capital Fund / Revolving Funds • O- Other • Excepted technicians in these categories will be coded “X” in DCPDS
Exempted Positions • Exempted positions are those supported by funding sources not subject to annual Congressional action • Personnel whose salaries are paid from a DoD • appropriation or fund that has sufficient funding • authority (e.g., multiyear appropriations with available • balances from prior years) will not be subject to • Furlough • Please contact your local Finance Office for • determinations regarding technicians for which this • applies • Exempted technicians in these categories will be coded “E” in DCPDS
Human Resource Officer’s (HRO) Role • Assist the Adjutant General in identifying “exempt” • and “excepted” technicians • Provide spreadsheet of these technicians to NG-J1-TN • Notify senior union officials when directed • Provide decision to furlough letters to supervisors • Review time limited appointments or promotions • Refer technicians to Family Readiness Center for • financial counseling and assistance • Review all pending adverse actions (suspensions, • removals) • Review timeliness of all pending disciplinary actions
Mass Processing of Personnel Actions • NG-J1-TN will update all Furlough Indicator Codes • (FICs) to “F” • HROs identifies exceptions by Category (i.e., • P: Protection of Life, etc.) and send list of exceptions • to NG-J1-TN • For exceptions, HROs update FIC to “X”, and • codes the appropriate Exception Category • NG-J1-TN will process a mass action that will flow a transaction to DFAS and hardcode the timecard with “KE” (furlough) to DFAS for all technicians
Mass Processing of Personnel Actions (Cont’d) • Upon return to normal operations: • Timecards for excepted technicians will be • corrected, and non-pay transaction cancelled • by NG-J1-TN for technicians receiving deferred • pay • Furlough/RTD SF50s processed IAW OPM/ • DOD direction, by NG-J1-TN
Furlough Rules of Engagement • All paid leave (annual, sick, military leave) is canceled • during the furlough period • No effect on the high-3 average for retirement • Federal technician Health Benefit premiums continue to be paid • Federal technician Group Life Insurance coverage • continues • Technicians receiving Continuation of Pay due to job related injury continues to receive compensation • While on furlough, technicians are not allowed to volunteer their • services at work • Technicians on approved LWOP under the Family and Medical • Leave Act (FMLA) during furlough will continue on LWOP • Program Reference: 5 CFR, Part 752
Obligation to Bargain • The decision to furlough is a management right • protected under 5 U.S.C. 7106(a)(2)(A) and does not • require collective bargaining • The Office of Secretary of Defense (OSD) will • provide notification to the national union • Representatives • Do not engage in I&I bargaining at this time • Please review your Collective Bargaining Agreement
Government Shutdown RPA Procedures • 99% of all HRO personnel will be furloughed during an emergency shutdown furlough • FILL ACTIONS • Announcements / Certificates – normal process upon return to Duty • Selection – if shutdown occurs, will extend certificates after return to duty for • those that expire during furlough • Tentative Job Offers – if shutdown occurs, will provide appropriate time for job • acceptance after return to duty • Firm Job Offers – starting 30 Sep, will stop making all firm job offers and send • notice to all selectees with a firm job offer to hold in place until further notice • OTHER ACTIONS • Upon return to duty we will work pay related issues ( WIGI’s, promotions, other) and approved temp/term extensions • For Planning Purposes Only; Subject to Change
Orderly Shutdown Requirements • Should appropriations lapse on 30 Sep 13: • Technicians will report to work on 1 Oct 13 for an orderly • shutdown • Technicians will be allowed 3 to 4 hours at work • This time will not be used to conduct work • Place out-of-office messages on phone and email • Clean up work area • Pickup accurate copy of recall roster • Provide supervisor with accurate contact • information • Collect all personal affects and take home • Depart the work site
