  1. Who has competence over health law? Competence over healthcare in the EU is not a straight forward matter Article 168 TFEU provides that human health protection will be ensured in all EU policies Under this provision the EU has launched public health campaigns However the EU specifically has no competence to organise healthcare systems The organisation of healthcare systems is therefore the sole jurisdiction of Member States This has not shielded national healthcare systems from interference from the EU in reality Healthcare systems come under the competence of the EU in so far as they involve workers, services and goods. Also Article 3 TFEU includes improving the well being of citizens as an EU aim Article 352 TFEU gives the EU the general competence to legislate to achieve the aims set out in the Treaty.
