  2. Důvod platnosti práva Iusnaturalismus: • Boží vůle • Rozum • Principy morálky • Přirozenost • Legitimita mocenského systému Pozitivismus: Normotvorná aktivita mocenských institucí.

  3. Spojovací x dělícíteze Iusnaturalismus: Právo a morálka spolu souvisejí Pozitivismus: Mezi právem a morálkou není nutná souvislost.

  4. Kognitivismus x nonkognitivismus Iusnaturalismus: Existuje možnost praktického poznání, tj. možnost objektivně zdůvodnit co je správné a co ne. Pozitivismus: Objektivně platné hodnoty (správné právo) nelze určit ryze kognitivně.

  5. Hodnoty x fakta Iusnaturalismus: Normy lze odvozovat nejen z norem, ale i z faktů. Pozitivismus: 1) Z faktů nelze vyvozovat normy. 2) Normy lze vyvozovat jen z norem. A to jen v rámci jednoho normativního systému.
