Engagement of Staff and Labor • Except as otherwise stated in the specification, the contractor shall make arrangement of all staff and labor, local or otherwise, and for their payment, housing, feeding and transport. تعيين المستخدمين والعمال: • ما لم ينص على خلاف ذلك في وثائق العقد، فإنه يتعين على المقاول أن يتخذ ترتيبات لتعيين ما يلزم من مستخدمين وعمال، محليين أو غيرهم، وسداد أجورهم ومستلزمات سكنهم وإطعامهم ونقلهم.

Rates of Wages and Conditions of Labors • The contractor shall pay rates of wages, and observe conditions of labor, which are not lower than those established for the trade or industry where the work is carried out. معدلات الأجور وشروط العمل: • يتعين على المقاول أن يدفع معدلات الأجور وأن يراعي شروط العمالة بحيث لا تقل في مستواها عما هو متبع من قبل أصحاب حرف التجارة والصناعة في المنطقة التي تنفذ فيها الأشغال.

Rates of Wages and Conditions of Labors • If no established rates or conditions are applicable, the contractor shall pay rates of wages and observe conditions which are not lower than general level of wages and conditions observed locally by employers whose trade or industry is similar to that of the contractor. • وإذا لم توجد مثل هذه المعدلات أو الظروف فإن على المقاول دفع معدلات الأجور ومراعاة ظروف العمالة بحث لا تقل عن المستوى العام للأجور أو الظروف التي يتم مراعاتها محلياً من قبل أصحاب العمل لمهن تجارية أو صناعية مشابهة لتلك التي يقوم بها المقاول.

Persons in the Service of Employer • The contractor shall not recruit, or attempt to recruit, staff and labor from amongst the employer's personnel. الأشخاص المستخدمون لدى أصحاب العمل: يتعين على المقاول ألا يستقطب أو يحاول استقطاب خدمات أي من المستخدمين أو العمال الذين يعملون ضمن أفراد صاحب العمل.

Labor Laws • The contractor shall comply with all the relevant labor laws applicable to the contractor's personnel, including laws relating to their employment, health, safety, welfare, immigration and emigration, and shall allow them all their legal rights. قوانين العمل: • ينبغي على المقاول التقيد بكل قوانين العمل الواجبة التطبيق على مستخدميه، بما في ذلك القوانين المتعلقة بالتوظيف والصحة والسلامة العامة والرعاية والإقامة والهجرة، وأن يراعي كل حقوقهم القانونية.

Labor Laws • The contractor shall require his employees to obey all applicable laws, including those concerning safety at work. • كما يتعين على المقاول أن يطلب من مستخدميه إطاعة القوانين الواجبة التطبيق، بما فيها أنظمة السلامة في العمل.

Working Hours • No work shall be carried out on the Site on locally recognized days of rest, or outside the normal working hours stated in the Appendix to Tender, unless: ساعات العمل: • لا يجوز تنفيذ الأشغال في الموقع خلال أيام العطل الرسمية المحلية المتعارف عليها أو خارج ساعات العمل المعتادة والمبينة في ملحق عرض المناقصة، إلا إذا:

Working Hours UNLESS: • otherwise stated in the contract, or • the engineer gives consent, or • the work is unavoidable, or necessary for the protection of life or property, or for the safety of all Works, in which case the contractor shall immediately advise the Engineer. • كان منصوصاً على خلاف ذلك في العقد، أو • تمت موافقة المهندس عليها، أو • كان الاستمرار في العمل أمراً حتمياً، أو كان ضرورياً لإنقاذ حياة الأشخاص، أو للمحافظة على سلامة الأشغال، وفي مثل هذه الحالة يتعين على المقاول إعلام المهندس فوراً بذلك.

Facilities for Staff and Labor • Except as otherwise stated in the Specification, the contractor shall provide and maintain all necessary accommodation, and welfare facilities for the contractor's personnel. • The contractor shall also provide facilities for the Employer's personnel as stated in the Specification. • ما لم ينص على خلاف ذلك في متطلبات صاحب العمل، فإنه يتعين على المقاول أن يوفر ويصون المرافق, وتجهيزات الإعاشة الضرورية لمستخدميه. • وعليه أن يوفر المرافق المنصوص عليها في المواصفات لأفراد صاحب العمل.

Facilities for Staff and Labor • The contractor shall not permit any of the contractor's personnel to maintain any temporary or permanent living quarters within the structures forming part of the permanent Works. • ينبغي على المقاول أن لا يسمح لأي من مستخدميه أن يتخذ أياً من المنشآت التي تشكل جزءاً من الأشغال الدائمة كمكان دائم أو مؤقت لإقامتهم.

Health and Safety • The contractor shall at all times take all reasonable precautions to maintain the health and safety of the contractor's personnel. الصحة والسلامة: • يتعين على المقاول أن يتخذ التدابير المعقولة في كل الأوقات للمحافظة على صحة وسلامة مستخدميه،

Health and Safety • In collaboration with local health authorities, The contactor shall ensure that medical staff, first aid facilities, sick bay and ambulance service are available at all times at the Site and at any accommodation for Contractor's and Employer's personnel, • على المقاول أن يوفر –بالتعاون مع السلطات الصحية المحلية- ما يلزم من كادر صحي، ومرافق الإسعاف الأولى، وغرفة منامة للمرضى وسيارة إسعاف، بحيث تكون جاهزة في كل الأوقات في الموقع وفي المساكن الجماعية لمستخدمي المقاول وأفراد صاحب العمل،

Health and Safety and that suitable arrangements are made for all necessary welfare and hygiene requirements and for the prevention of epidemics. وأن يوفر كذلك الترتيبات المناسبة لمتطلبات الصحة العامة ولمنع انتشار الأوبئة.

Health and Safety • The contractor shall appoint an accident prevention officer at the Site, responsible for maintaining safety and protection against accidents. • يتعين على المقاول أن يعين ضابطاً للوقاية من الحوادث في الموقع، بحيث يكون هذا الشخص ذا تأهيل مناسب ليكون مسئولا عن أمور السلامة والوقاية ضد الحوادث

Health and Safety • This person shall be qualified for this responsibility, and shall have the authority to issue instructions and take protective measures to prevent accidents. • Throughout the execution of the works, the contractor shall provide whatever is required by this person to exercise this responsibility and authority. وأن يكون مخولاً بصلاحية إصدار التعليمات واتخاذ الإجراءات الوقائية اللازمة لدرء الحوادث، وفي هذا السياق يتعين على المقاول يوفر لضابط الوقاية كل ما يلزم لتمكينه من ممارسة صلاحيته ومسؤولياته.

Health and Safety • The contractor shall send, to the Engineer, details of any accident as soon as practicable after its occurrence. • The Contractor shall maintain records and make reports concerning health, safety and welfare of persons, and damage to property, as the Engineer may reasonably require. • كما يتعين على المقاول أن يرسل إلى المهندس تفاصيل أي حادث يقع حال حصوله، • وأن يقوم بحفظ السجلات ويقدم التقارير المتعلقة بالصحة والسلامة العامة والأضرار التي قد تلحق بالممتلكات على النحو الذي يطلبه المهندس بصورة معقولة.

Contractor's Superintendence • Throughout the execution of the works, and as long as thereafter as is necessary to fulfill the Contactor's obligations, the Contractor shall provide all necessary superintendence to plan, arrange, direct, manage, inspect and test the work. مناظرة (مراقبة) المقاول: • ينبغي على المقاول أن يوفر كل المناظرة اللازمة للتخطيط والتوجيه والترتيب والإدارة والتفتيش واختبار الأشغال، طيلة فترة التنفيذ وبعدها لأي فترة تلزم لقيام المقاول بالتزاماته.

Contractor's Superintendence • Superintendence shall be given by a sufficient number of persons having adequate knowledge of the language for communications (defined in Sub-clause 1.4[law and language]) • and of the operations to be carried out (including the methods and techniques required, the hazards likely to be encountered and methods of preventing accidents), for the satisfactory and safe execution of the Works. • ينبغي أن يقوم بالمراقبة عدد كاف من الأشخاص المؤهلين لاستخدام لغة الاتصال (عملاً بأحكام المادة 1/4) • وبالعمليات التي يتم تنفيذها (بما في ذلك الأساليب والتقنيات المطلوبة والمخاطر المحتمل التعرض لها وطرق منع الحوادث)، لغاية تنفيذ الأشغال بصورة مرضية وآمنة.

Contractor's Personnel • The Contractor's personnel shall be appropriately qualified, skilled and experienced in their respective trades or occupations. • The Engineer may require the Contractor to remove (or cause to be removed) any person employed on the Site or Works, مستخدمو المقاول: • يجب أن يكون مستخدمو المقاول ذوي كفاية ومهارة وخبرة مناسبة كلاً في مهنته أو حرفته. • وبإمكان المهندس الطلب إلى المقاول أن يقوم بإبعاد (أو أن يعمل على إبعاد) أي شخص مستخدم في الموقع أو في الأشغال،كما يلي:

Contractor's Personnel This remove includes even the Contractor's representative if applicable, Who: • persists in any misconduct or lack of care, • carries out duties incompetently or negligently, • fails to conform with any provisions of the Contract, • persists in any conduct which is prejudicial to safety, health, or the protection of the environment. بمن فيهم ممثل المقاول، إذا كان الشخص: • متمادياً في مسلكه أو عدم مبالاته بصورة مستمرة، أو • أنه يقوم بواجباته بشكل غير كافي أو بإهمال، أو • أنه يخفق في بتطبيق أي من أحكام العقد، أو • أنه متماد في سلوك مسلك يهدد السلامة أو الصحة أو حماية البيئة.

Contractor's Personnel • If appropriate, the Contractor shall then appoint (or cause to be appointed) a suitable replacement person. • وإذا كان ذلك مناسباً، فعلى المقاول عندئذ أن يعين (أو يعمل على تعيين) شخص بديل مناسب.

Records of Contractor's Personnel and Equipment • The Contractor shall submit, to the Engineer: • details showing the number of each class of contractor's personnel • and of each type of Contractor's Equipment on the Site. سجلات العمال ومعدات المقاول: • يتعين على المقاول أن يزود المهندس بسجلات مفصلة لبيان ما يتوفر في الموقع من إعداد مستخدمي المقاول مصنفين حسب المهارات، • ومن إعداد معداته مصنفة حسب الأنواع.

Records of Contractor's Personnel and Equipment • Details shall be submitted each calendar month, in a form approved by the Engineer, until the Contractor has completed all work which is known to be outstanding at the completion date stated in the Taking-Over Certificate for the Work. • يتم تقديم هذه السجلات إلى المهندس كل شهر، باستعمال النماذج التي يوافق عليها المهندس وذلك إلى أن ينجز المقاول أي عمل معروف لا متبقياً بتاريخ الإنجاز المحدد في "شهادة تسلم الأشغال".

Disorderly Conduct • The Contractor shall at times take all reasonable precautions to prevent any unlawful, riotous or disorderly conduct by or amongst the Contractor's personnel, • and to preserve peace and protection of persons and property on and near the Site…. السلوك غير المنضبط: • يتعين على المقاول أن يتخذ في جميع الأوقات كل الاحتياطات المعقولة للحيلولة دون وقوع أي شغب أو تجاوز على القانون أو إخلال بالنظام من قبل مستخدمي المقاول أو فيما بينهم، • وأن يحافظ على الأمن وحماية الأشخاص والممتلكات في الموقع وما يجاوره....
