  2. City of North Richland Hills signed up to use E-Verify in July 2008. • To use E-Verify you must complete a tutorial to familiarize yourself with the employer responsibilities relating to this program. • Must pass test after completing the tutorial.

  3. Employer must print and post the English and Spanish versions of the E-Verify Participation and the Right to Work posters. • Posters must be displayed in plain view at your hiring sites.

  4. Newly hired employees must complete a Form I-9 before you can use E-Verify. • Employer must make verification through E-Verify for newly hired employees within three business days of when they are hired.

  5. Ensure notice is given to employees regarding use of E-Verify. • Use E-Verify only after a new employee has completed the I-9. • Cannot use E-Verify to screen job applicants or re-verify employment eligibility. • Never use E-Verify selectively – must verify all new employees.

  6. Confirmation of Work Authorization • After new employee information is submitted to E-Verify the system will indicate whether work authorization has been confirmed (Employment Authorized). • Or if further action is needed (Tentative Nonconfirmation).

  7. Do not change an employees employment status if you receive an initial E-Verify report indicating the system has not conclusively verified new employee information. • Do not immediately terminate or suspend a new hire solely because the system returns a Tentative Nonconfirmation for the employee.

  8. Never take adverse action against an employee, including suspension or termination, while he or she contests a Tentative Nonconfirmation. • Ensure employees who contest a Tentative Nonconfirmation are provided with the printed referral letter from E-Verify.

  9. If employee contests, they have to contact the SSA or DHS with in eight work days to address any discrepancies.

  10. There are five options for resolving a case: • Resolved Authorized: Select this option when employment is authorized. • Resolved Unauthorized/Terminated: Select this option when employment is not authorized (SSA Final Nonconfirmation, DHS Final Nonconfirmation or DHS No Show) or when a Tentative Nonconfirmation response is uncontested AND employment is terminated. • Self Terminated: Select this option if an employee quits or is terminated for reasons unrelated to employment eligibility status while the verification query is in process. • Invalid Query: Select this option if a duplicate query was discovered after the query was sent or if a query was sent with incorrect data. • Employee Not Terminated: Select this option to notify DHS that you are not terminating an employee who received an SSA Final Nonconfirmation, DHS Final Nonconfirmation, or DHS No Show response or who is not contesting a Tentative Nonconfirmation response.

  11. NRH Experience with E-Verify • Initial Verification Results came back as Tentative Nonconfirmation. • Employee was notified his information could not be verified and that he needed to contact the SSA. • The employee went to the SSA office in Fort Worth and resolved the issue. • SSA issued Resolved Authorized for employee.
