National Pollution Discharge Elimination System (NPDES)Phase IIWater Quality Committee, 12/10/2004
What is the Purpose of the Phase II NPDES Stormwater Regulation? • Satisfy the appropriate water quality requirements of the Clean Water Act. • Protect water quality and aquatic habitat. • Reduce the discharge of pollutants to the “maximum extent practicable” (MEP). Phase II Purpose
Phase II NPDES Small MS4 RegulationsWho’s In? • Automatic Designation • Urbanized Areas > 50,000 & 1,000/sq mi • State Designation • Urbanized Areas > 10,000 & 1,000/sq mi • Petitioning • Apex • Cary • Garner • Fuquay-Varina • Holly Springs • Knightdale • Morrisville • Rolesville • Wake Forest • Wake County Notes: • City of Raleigh is a NPDES Phase I Community • Wendell and Zebulon are not currently regulated
NPDES II Compliance Minimum requirement: • County must implement Stormwater Management Plan (SMP) for County-owned MS4s in designated urban areas within its jurisdiction Options: • County implements SMP throughout the designated urban areas in its jurisdiction • County request State to implement SMP in its NPDES II jurisdiction, except for publicly owned MS4s (Wake Co, WCPSS, Wake Tech.)
Phase II NPDES Small MS4 RegulationsWhat is the Stormwater Management Plan? • Control Stormwater Pollution to the Maximum Extent Practicable (MEP) • Six Minimum Control Measures • Public Education and Outreach • Public Involvement • Illicit Discharge Detection and Elimination • Construction Site Runoff • Post-Construction Controls • Municipal Operations - Pollution Prevention
Phase II NPDES Small MS4 RegulationsPublic Education and Outreach • Menu of Permit BMPs: • Establish a Public Education and Outreach Program • Informational Web Site • Public Education Materials for Schools, Homeowners and Businesses • Public Education Material Dissemination Brochures Recreation Guides Library Events Volunteers Stenciling Signage
Phase II NPDES Small MS4 RegulationsPublic Involvement and Participation • Menu of Permit BMPs: • Administer a Public Involvement Program • Organize a Volunteer Community Involvement Program • Establish a Citizens Advisory Panel Meetings Volunteers Stenciling Clean-ups Lake Watch “Adopt A Stream”
Phase II NPDES Small MS4 RegulationsIllicit Discharge Detection and Elimination • Menu of Permit BMPs: • Develop/Implement an Illicit Discharge Program • Establish and Maintain Appropriate Legal Authority • Develop a Storm Sewer System Base Map • Implement Illicit Discharge Detection Procedures • Conduct Employee Cross-Training • Provide Public Education • Establish a Public Reporting Mechanism
Phase II NPDES Small MS4 RegulationsConstruction Site Runoff Controls • Menu of Permit BMPs: • Implement a Program and Establish a Regulatory Mechanism for Erosion and Sediment Control • Develop Requirements for Construction Site Operators • Provide Educational Training Materials for Construction Site Operators • Institute Plan Reviews • Establish Public Information Procedures • Establish Inspection and Enforcement Procedures
Phase II NPDES Small MS4 RegulationsPost Construction Plan for New Development • Menu of Permit BMPs: • Establish a Post Construction Stormwater Program • Develop Community Education • Establish Compliance and Enforcement Procedures • Establish Strategies for Structural and Non-Structural Controls • Ensure BMP Design, Construction and O&M Compliance • Establish Fecal Coliform Control Program • Establish Buffer Requirements • Establish Low Density Development Requirements • Establish High Density Development Requirements • Establish Nutrient Sensitive Waters Protection Measures
Phase II NPDES Small MS4 RegulationsMunicipal Operations – Pollution Prevention • Menu of Permit BMPs: • Develop O&M Program for Municipal Operations • Inspection and Evaluation of Facilities and Operations • Conduct Staff Training • Review Regulated Industrial Activities
Summary of Key Compliance Issues for NPDES MS4 Phase II • Compliance is Measured by Annual Report • Key to Compliance is Documentation • Permit is Issued to Whole Municipality or County, Not Just Stormwater Department • Map Your Outfalls • Permit is related to outfalls to US • You need to know where you system is

Neuse River Nutrient Sensitive Waters Strategy (i.e. “Neuse Rules”) • Review and approve stormwater management plans for new development • Requirements for riparian buffers • Implement public education program • Identify and remove illegal dischargers • Identify retrofit areas • Submit annual report Neuse River Basin Cape Fear Basin NOTE: Raleigh, Cary and Wake County have been designated for these stormwater management requirements
Water Supply Watershed Protection • Requires limitation of impervious surfaces • Requires protection of riparian buffers • Limits some land uses • Limits certain types of dischargers • Allows the use of clustering and density averaging WS-VI WS-II WS-VI WS-III
