How to Start a Family-Based Immigration Petition A family-based immigration petition is started by preparing and filing a United States Customs and Immigration Service (USCIS) Form I-130. Only a U.S. citizen or legal permanent resident (green card holder) may petition or sponsor a qualifying family member.
