CZ-2009-47 APPLICANT: Greenville County Planning Department REQUEST: Text Amendment to add Section 8:8 to the Greenville County Zoning Ordinance to Create Overlay Districts
Section 8:8 Overlay Districts 8:8.1Intent An overlay district imposes or relaxes a set of requirements imposed by the underlying zoning district(s) when there is a special public interest in a particular geographic area of the County that does not coincide with the underlying zoning district(s). (Per Chapter 29 Article 3 Section 6-29-720 of the SC Code of Laws) Overlay districts can be adopted to: Protect areas of historical, natural, and/or scenic significance; Ensure compatible and harmonious development; Maintain and set forth specific design criteria for residential and/or non-residential development; Protect environmentally sensitive areas such as watersheds, waterway corridors, and recreation areas; and/or Provide additional zoning requirements when needed based on staff recommendations. 8:8.2 Initiation of Overlay District Overlay districts may be initiated at the request of the Planning Commission, Board of Zoning Appeals, or County Council. All overlay districts must be approved by County Council and shall follow the review procedure for text and/or map amendments set forth in Article 3 Section 3:2 of the Greenville County Zoning Ordinance (GCZO). Any of the aforementioned bodies may initiate changes or amendments to an existing overlay district. Proposed areas for overlay districts must meet the following criteria prior to being considered for initiation: Located within the zoned area of the unincorporated area of the County; Contain a minimum of 100 acres of contiguous property; and Meet the intent of overlay districts as defined above. 8:8.3 Text and Map for Overlay District Proposed text and map amendments must be approved in compliance with Section 8:8.2, Initiation of Overlay District. County Council shall review and approve all proposed overlay district maps and accompanying guidelines. The Planning Commission, Public Works Planning and Development Committee or County Council may amend proposed overlay district maps and accompanying text prior to final approval. 8:8.4 Variances Variances from an approved overlay district must be submitted to the Board of Zoning Appeals for consideration. The procedure for filing a variance may be found in Article 3 Section 3:4 of the GCZO.
CZ-2009-48 APPLICANT: Greenville County Planning Department REQUEST: Text Amendment to add Section 8:8.5 to the Greenville County Zoning Ordinance to Create an Overlay District for the North and South Harrison Bridge Road Area
Intent To preserve the established residential character of the area and require new residential developments to adhere to the existing architectural design and size of the residences that have been developed in the area. District Requirements 1. Parcels subdivided into three (3) or more tracts for single-family residential use shall require new residences to meet the following requirements: a. Minimum housing size of 1,850 square feet of living area, which includes the heated floor area of a residential structure, but excludes unfinished areas such as basements, attics, garages, unheated porches, and maintenance shops; b. Minimum 5:12 roof pitch as measured as the ratio of the rise of the roof to its horizontal run; and c. Minimum setback from North Harrison Bridge Road, South Harrison Bridge Road, and New Harrison Bridge Road of seventy-five (75) feet from the road right-of-way.
