EEO Protected Bases What is the basis for the alleged discrimination? • Race • Color • National Origin • Age • Equal Pay • Religion • Sex (Gender) • Sexual harassment • Pregnancy • Genetic Information • Disability • Retaliation • Sexual Orientation (Executive Order 13087) • Status as a Parent (Executive Order 13152)
Claim or “Harm” You were harmed in your workplace You believe this happened to you because of your EEO protected category • Unfair appraisal • Denied achievement award • Unequal terms and conditions of employment • Denied or unequal bonus • Forced resignation • Forced retirement • Constructive discharge • Force transfer/or detail • Warning • Reprimand • Suspension • Termination • Removal • Harassment • Denial of reasonable accommodation • Denied promotion or hire • Denied training • Unequal wages

The EEO complaint process starts with the Informal Complaint • Initial intake is conducted with the individual • What is the basis? What is the claim? (What is the harm?) • EEO staff processes the complaint, but does not make a determination as to whether discrimination occurred, or did not occur • Aggrieved will determine: • Traditional EEO counseling (30 days to complete) • Alternative Dispute Resolution (ADR) or mediation (90 days to complete)
Federal Sector Complaint Process: Informal(Under 29 CFR 1614) Occurrence 45 days EEO Contact Alternative Dispute Resolution (ADR) Traditional Counseling Notice of Right to File Formal 30-90* days Resolved Resolved 15 days * Maximum time for counseling (30 days)/ for ADR (90 days).
