CHANGES ANNOUNCED ON THE 8TH OF FEBRUARY 2010 • Abolition of the MODL (Migration Occupations in Demand List) • A new SOL (Skilled Occupation List) • Revocation of the CSL (Critical Skills List) and changes to the current priority processing • New rules for Skills Assessments • Review of the Points Test for Skilled Migration • Cap and Cease of Offshore GSM Applications Lodged Prior to 1 September 2007 (NOT APPLICABLE TO ONSHORE STUDENTS)

ABOLITION OF THE MODL What does it mean? *15 points will no longer be available for applicants whose occupation was on the MODL Who will be affected? * Candidates who have not lodged an application for a GSM visa until the 7th of February 2010 (provisional or permanent). Who will NOT be affected? *Candidates who have lodged a GSM application prior to 8th of February 2010 (including Graduate Skilled Visas and Permanent Visas).

  4. Review and Creation of a new SOL (Skilled Occupation list) What does it mean? *DIAC is in the process of reviewing the current skilled occupation list. They will cancel the current SOL and implement a new SOL more targeted to the australian skills needs. When will the new list take effect? * DIAC will announce the new list on the 30th of April 2010 however it will only be applicable from mid 2010 (no specific date set as yet).

Who will be affected and how? *Candidates that do not lodge an application for a permanent visa to Australia by the date the new SOL is implemented will be assessed under the new SOL (excluding those who have lodged an application for a Graduate Skilled Visa or a Permanent Visa prior to 8th of February – and who lodge a permanent visa application by 31/12/2012). *Candidates that are currently studying a Diploma and intend to apply for a GSM visa, will continue to be able to apply for a Graduate Skilled Visa under the current SOL. However, when applying for a permanent visa they will be assessed under the new SOL. *For those candidates whose occupation remains on the new SOL; a pathway for a permanent visa through the points test system will remain available. *For those candidates whose occupation is no longer on the list, the only pathway for Permanent residency will be through Sponsorship (Employment Nomination Scheme) by a company or through “a state migration plan approved by the Minister”.

  6. Who will not be affected? *Candidates who have lodged an application for a permanent visa or Graduate Skilled Visa prior to 8th of February 2010.

  7. NEW RULES FOR SKILLS ASSESSMENT - TRA * In January 2010 DIAC announced that applicants who nominate a trade occupation would have to provide a skills assessment dated on or after 1 January 2010, which would force people to undertake the TRA Job Ready Program. * This now has been changed and the amendments now say that people who have a skills assessment dated from before 1 January 2010 might be able to use that assessment and apply directly to a permanent visa without having to do the Job Ready Program. *Arrangements for this provision to come into effect will be announced in first quarter of 2010. *This is a great outcome for students who have already applied for their skilled graduate subclass 485 visas.

  8. Revocation of the CSL and new priority processing What does it mean? *DIAC will eliminate the current CSL together with the implementation of a new SOL. *The government will always prioritize applications through a company sponsorship. Such applications take anywhere between 2 to 4 months to be finalized whereas a points test application (independent) takes anywhere between 2 to 3 years to be finalized.

  9. REVIEW OF THE POINTS TEST • There will be a review of the GSM Points Test in the first half of 2010, however at the moment there is no certainty if and/or when such changes will take place. • The Minister said that the review would consider: • Should some occupations warrant more points than others? • Are the points for age properly calibrated? • Should points be awarded for qualifications acquired overseas from prestigious universities? • Are sufficient points awarded for experience? • Should more points be awarded for excellence in English? • We will have to wait until the changes above are announced.
