3. Why are SESIR and Discipline Data Important? Provides data: • For needs assessment for grant opportunities • For measuring progress of intervention • For reporting to advisory councils

4. SESIR Key Features • Developed 1995 for school staff • Based on criminal code but not identical • 21 incidents through 2005-06, 22 through 2009-10 • 23 incidents now • Each incident may have related elements: alcohol, bullying, drug, gang, hate-crime, or weapon

5. SESIR Incidents • On school grounds, school transportation, or at off-campus school sponsored events • The most serious offense is the primary SESIR incident. Secondary offenses can be reported as “related elements”. • 365 days/24 hours • Student, Non-Student or Unknown Offenders

6. SESIR Reporting • SESIR incidents are per incident. Report only ONE incident even when there are multiple students involved in the same incident. • Discipline actions are per student.

Incident:Bullying (BUL) The incident is bullying if the incident includes systematically and chronically inflicting physical hurt or psychological distress on one or more students or employees that is severe or pervasive enough to create an intimidating, hostile, or offensive environment; or unreasonably interfere with the individual’s school performance or participation.

Incident:Harassment (HAR) Any threatening, insulting, or dehumanizing gesture, use of data or computer software, or written, verbal, or physical conduct that • places a student or school employee in reasonable fear of harm to his or her person or damage to his or her property, • has the effect of substantially interfering with a student’s educational performance, opportunities, or benefits, or • has the effect of substantially disrupting the orderly operation of a school including any course of conduct directed at a specific person that causes substantial emotional distress in such a person and serves no legitimate purpose.

Incident:Unsubstantiated Bullying (UBL) After a complete investigation and follow up of a reported bullying incident, the investigator determines that there is not enough evidence to substantiate that the incident meets the criteria of a prohibited act under the definition of bullying as listed in the Jeffery Johnston Stand Up for all Students Act (section 1006.147, F.S.).

Incident:Unsubstantiated Harassment (UHR) After a complete investigation and follow up of a reported harassment incident, the investigator determines that there is not enough evidence to substantiate that the incident meets the criteria of a prohibited act under definition of harassment as listed in the Jeffrey Johnston Stand Up for all Students Act (section 1006.147, F.S.).

Data Element:Incident, Reported to Law Enforcement Y Yes - An official action was taken by a School Resource Officer (SRO) or local Law Enforcement Officer such as: a case number was assigned, a report was filed, an affidavit was filed, an investigation was conducted and found to be an incident reportable to SESIR OR an arrest was made. N No – The incident was not reported to a School Resource Officer (SRO) or local Law Enforcement Officer. Optional. For local use only. C Consultation – A School Resource Office (SRO) or local Law Enforcement Officer was consulted regarding the incident but no official action was taken. Note: When reporting to the State convert code C to code N.

21. Data Element:Incident, Basis - Sex An indicator of whether the bullying or harassment incident was on the basis of sex. Harassment or bullying on the basis of sex is unwelcome conduct of a sexual nature, such as unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature. Harassment or bullying on the basis of sex also includes gender-based, nonsexual harassing conduct, such as harassment based on gender stereotyping. Both male and female students can be victims of sexual harassment, and the harasser and the victim can be of the same sex.

22. Data Element:Incident, Basis – Sex (continued) Y-The bullying or harassment incident was on the basis of sex. N-The bullying or harassment incident was not on the basis of sex. Z-Not a bullying or harassment incident.

23. Data Element:Incident, Basis - Disability An indicator of whether the bullying or harassment incident was based on the person’s disability. Y-The bullying or harassment incident was based on the person’s disability. N-The bullying or harassment incident was not based on the person’s disability. Z-Not a bullying or harassment incident.

24. Data Element:Incident, Basis - Race An indicator of whether the bullying or harassment incident was based on the person’s race, color or national origin. Y-The bullying or harassment incident was based on the person’s race, color or national origin. N-The bullying or harassment incident was not based on the person’s race, color or national origin. Z-Not a bullying or harassment incident.
