Section 340 Southern WV Environmental Infrastructure • Authorization • Authorized by WRDA 92 (Sec. 340) • Amended by WRDA 96 (Sec. 359) • Amended by WRDA 99 (Sec. 368) • Amended by WRDA 00 (Sec. 550) • Amended by WRDA 07 (Sec. 5156) • Allowed 10% of annual appropriation for program administration • Added Nicholas County to program • Allowed non-profit entities to serve as local sponsors • Funding • Authorized Program Limit – $40M • $23.4M appropriated thru FY 08 • $21.4M appropriated thru Corps authorities • $2M appropriated thru ARC authorities in FY 06 • 75% / 25% cost share • Scope • Water and wastewater • Surface water resource protection and development • Environmental restoration • PPA execution authority delegated to District • WRDA 07 implementation may require new PPA model

Section 571 Central WV Environmental Infrastructure • Authorized in Section 571 of WRDA 99 • Amended by WRDA 07 (Sec. 5155) • Removed Nicholas and Gilmer Counties from Sec. 571 Program • Increased program limit to $20M • Allowed non-profit entities to serve as local sponsors • Allowed 10% of annual appropriation for program administration • Funding • Authorized Program Limit – $20M • $12M appropriated thru FY 08 • $10M appropriated thru Corps authorities • $2M appropriated thru ARC authorities in FY 06 • 75% / 25% cost share • Scope • Water • Wastewater • Surface water resource protection and development • PPA execution authority delegated to District • WRDA 07 implementation may require new PPA model

WV Environmental Infrastructure – Section 340and 571 • Announce funding availability of 340 program • Applications submitted to WV Infrastructure and Jobs Development Council (IJDC) • IJDC reviews applications and recommends projects • USACE reviews project applications • USACE prioritizes based upon established criteria • Notifies applicants
