6. Appellate Review of Punitive Discharges Service members who are court-martialed and sentenced to a punitive discharge (bad conduct, dishonorable, dismissal) are entitled to appeal
Per UCMJ, punitive discharge or dismissal may not be executed until appellate review completed

Appellate process can be very lengthy
Military members with pending punitive discharge or dismissal are often placed in involuntary excess leave status called Appellate Leave
(Bad Conduct Discharge (BCD), Dishonorable Discharge (DD) or Dismissal (officers only)) from a court-martial. A punitive discharge, unlike other forms of court-martial punishment, can not be executed until the case has been reviewed by a military appeals court. The appeals process can take from one year to several years to be completed. Members may be placed on appellate leave while the appeals process is underway. While on appellate leave you are on active duty in an excess leave status.
This includes members who plead guilty at their court-martial since all cases are automatically reviewed.
The member is considered to be on active duty and is subject to the Uniform Code of Military Justice while on appellate leave.
While the member is entitled to full health care benefits and other privileges of being on active duty, the member receives no pay or allowances and is not required to perform any military duties.

Leave status members are placed voluntarily or involuntary who were sentenced by court-martial to dismissal or to receive an unsuspended punitive discharge, but whose sentence has not yet been approved, provided all confinement (if any) has been completed.
Members on appellate leave are administratively assigned to the Navy and Marine Corps Appellate Leave Activity (NAMALA) Washington D.C. as their parent command until completion of appeals for court-marital conviction.
NAMALA provides a memorandum to all Sailors and Marines on appellate leave outlining their responsibilities while on appellate leave includes guidance on medical and dental care.
Navy allows member to enroll to closest MTF to their appellate leave address
In the event transfer of enrollment cannot be accomplished and member remains enrolled at a Navy MTF places undue hardship on the ADSM due to driving times and or distances, MTFs will contact their Navy Medicine Regional TRICARE Operation staff to assist with the transfer to another Services MTF.
11. SMs on Appellate Leave are enrolled to the MTF that supports the Personnel Control Facility (PCF) that manage these SMs after release from a Regional Correction Facilities (RCFs)
Army has 2 PCFs and 1 Disciplinary Barracks:
Ft Knox, KY (Ireland Army Community Hospital)
Ft Sill, OK (Reynolds Army Community Hospital)
Ft Leavenworth, KS (Munson Army Health Center)
For any Appellate Leave SM (regardless of Service) that shows up at any MTFs door, do the following:
Say how can we help you?
See to their healthcare needs by registering them to your MTF.
If defer to network is required, the UIN process supports.
Then validate with them where they live and is your MTF the most appropriate option for their continued healthcare needs.
Army has 5 installations where SMs are assigned to during their appellate leave determination.
MEDCOM continues close collaboration of PCF/RCF and supporting MTF.
We continue to reiterated that when a SM is transferred in/out of a PCF/RCF, the formal In-/Out-processing based on AR 600-8-101/DA PAM600-8-101 must be followed and the MTF must be informed so that the arriving/departing SM can have their TRICARE enrollment transferred to the MTF during the incarceration phase (In-processing).
If the SM is placed on Appellate Leave/Parole (Out-processing), the MTF must again be involved as the SM will have to be educated on healthcare execution while on Appellate Leave/Parole.
Under the MEDCOM current interim design, the majority of these SMs coming out of incarceration and placed on Appellate Leave/Parole will remain enrolled in the MTF that supports the RCF.
The SM must obtain all their care and go through their PCM to coordinate any medical care they may need.
The MTF must help educate the SM on how to obtain medical care and coordinate their care while they are on appellate leave. If that "duty at home" is within another MTF's Prime Service Area (PSA), then this must be discussed with the SMs to see if the best solution for their situation requires transfer of Prime enrollment to that MTF.
We continue to collaborate with Corrections Command to see if the official order process is changed to have an endorsement to show "duty at home," then the MTF must help educate the SM on how to enroll within another MTF's PSA and transfer their enrollment if needed.

Ensure TRICARE Prime enrollment is submitted and they coordinate any remote civilian healthcare with their enrolling MTF/PCM
MMSO May be asked to assist with claims adjudication, and does re-direct Appellate Leave SMs back to their enrolling MTF and PCF.
HQDA, Army Corrections Command and DEERS/RAPIDS - Support clean-up and proper DEERS recording of Appellate Leave.
Request for possible change in Official Order Format to augment Appellate Leave; greater command and control and would allow TRICARE Prime Remote (TPR) enrollment.
New Discoveries:
Clean-up/Clean-out of DEERS showing eligibility of Appellate Leave and Parole SM that are already officially discharged.
NOTE: Mr. Jackson, HRC DEERS/Rapids Discussions on how to assist PCFs on cleaning out the
discharged SMs.
A glitch in the systems interface might have been causing officially discharged Appellate Leave and Parole SMs from not dropping from DEERS. MEDCOM requested that when the clean-up is done that the list of all discharged SMs be provided to the MTFs that support the RCF/PCF so that the
MTF can dis-enroll (due to loss in eligibility) those discharged Appellate Leave/Parole SMs that are showing on their books.
Change in Official Order Format
There was discussion on how Appellate Leave and Parole SMs can be placed on official orders showing assignment to the PCF, but with duty at "home."
The proposed solution that Corrections Command is looking at is an "Endorsement" to the PCF assignment order.
What this change in Official Orders will do is:
(1) Allow the Appellate Leave/Parole SM to enroll in TPR (just like we do now for CBWTU Soldiers);
(2) Will allow the co-residing family members of an Appellate Leave/Parolee to enroll in TPRADFM (the families of these SMs had been lost in the shuffle)
(3) Will provide the PCF with greater Command and Control (C2) over their Appellate Leave SMs as the endorsement shows a duty at home and if the Appellate Leave SM moves, then they MUST inform the PCF.

Terminal Leave is accrued leave granted to both first term and career ADSM to ease the transition back to civilian life, but granted at the discretion of the commanding officer.

17. How to Obtain Leave Entitlements Marine Corps - Leave must be approved by both CMC and the current command.
The Services shall advise ADSMs enrolled at a MTF and transitioning to terminal leave status how they should access health care services until their separation or retirement date.
AF bases have congressionally mandated separations briefs which includes medical care
18. How to Obtain Leave Entitlements Determine if the ADSM intends, while on terminal leave, to reside inside or outside of the PSA of the MTF where the ADSM is enrolled.
If the ADSM intends to reside INSIDE the PSA of the MTF, he/she will use the MTF.
19. How to Obtain Leave Entitlements If the ADSM intends to reside OUTSIDE of the PSA of the MTF, he/she may obtain a single authorization to receive any routine and urgent outpatient primary medical care from the Department of Veterans Affairs.
Single authorization covers any outpatient primary medical care at the VA that should be required by the ADSM at anytime during the terminal leave period.
Does not apply to services provided through the VA for Polytrauma Injury, Spinal Cord Injury, Traumatic Brain Injury or Blindness.
20. How to Obtain Leave Entitlements If the ADSM desires to obtain routine or urgent medical care in the private sector and not the VA, he/she must secure an authorization from the MTF for each episode of care.
If using the VA, ADSMs should contact their MTF PCM to request the single authorization.
AF use Patient Admin or Referral Management Center at their assigned MTF for single authorization.
PCM should send pre-authorization to the MCSC before the ADSM departs his/her final duty station to commence terminal leave.
Pre-authorization shall be the entire anticipated span of the terminal leave period.
ADSMs will continue to be eligible for care until the day of their End of Active Service (EAS).
21. ADSMs will be advised that should they subsequently incur a previously undiagnosed illness or injury while on terminal leave, they may be directed to return to duty at their last permanent duty station for medical treatment and further processing.

22. Army Leave Entitlements Transitional Leave period is NOT an authorized period for medical evaluations.
Evals should have been completed prior to leave status.
Service Members must present a copy of their approved and signed DA 31 for Transition Leave

Soldiers may start Transition Leave with an active treatment plan still in effect - Wounded Ill and Injured population.
The MTF/PCM must support care coordination at Transition Leave location.
This process mimics Convalesant Leave coordination.

28. Temporary Disability Retirement List As long as the member is on TDRL or PDRL, he or she is eligible for TRICARE benefits and must be registered in DEERS.

41. How Services Reserve Component Obtain LOD Entitlements
Sailors and Marines must contact their assigned Medical Department Representative/Limited Duty Coordinator (Navy Operational Support Center (NOSC) for Sailors ) / (Reserve Training Centers (RTC) for Marines) to initiate the LOD and coordinate all LOD Care.
Airmen must contact their supporting Reserve Medical Unit / MTF to coordinate their appointments and provide Patient Admin a copy of their LOD or orders for verification. MTF can verify eligibility for LOD care by calling the Air Force Reserve Command toll-free number.

Soldiers must contact their Unit Administrator to coordinate their care. LOD's on Army RC members MUST be initiated upon initial treatment for the medical conditions treated at MTFs and/or civilian hospitals.
If the Soldier lives within 50 miles of an MTF, the LOD is filed with the PAD. The MTF is responsible for the Soldiers care.
All Service members:
Residing within 50 miles or approximately one hour drive time of an MTF medical and dental treatment will be through a MTF.
Pre-authorization is not needed for treatment at a MTF however a MTF may refer the member to a Civilian Physician for care.
42. How Services Reserve Component Obtain LOD Entitlements cont. If member resides greater than 50 miles from a MTF,
pre-authorization MUST be obtained from the Military Medical Support Office (MMSO) for remote area LOD-related care.
