Starting point European Council of Thessaloniki, June 2003: “a coherent approach is needed in the EU on biometric identifiers or biometric data which would result in harmonised solutions for documents for third country nationals, EU citizens’ passports and information systems (VIS and SIS II)”, and invited the Commission “to prepare the appropriate proposals, starting with the visa”
Biometrics in travel documents • Commission presented first proposals for integrating biometrics into the uniform format for visa and the uniform residence permit for third country nationals. • Commission presented a proposal on the introduction of biometrics in EU citizens’ passports.
Commission proposals on the integration of biometric identifiers into the visa and residence permit (Sept 2003) • to bring forward the final date for the implementation of the photograph from 2007 to 2005 and at the same time, • require Member States to integrate biometric identifiers into the visa and the residence permit for third country nationals in a harmonised way (interoperability). • provide for the mandatory storage of the facial image as a primary biometric identifier for verification (one-to-one checks at the border); • an obligatory, second biometric identifier: fingerprint, provides the best solution for so-called “background checks”, in databases. • Two flat fingerprints have been chosen as second mandatory biometric identifier in order to enable verification at the border post as an initial additional security element. • Storage: on a storage medium (RF chip in compliance with ICAO)
Proposal on integrating biometric identifiers into the visa and residence permit Council of 27 November 2003: • Political agreement on Commission proposals subject to technical feasability 16 November 2004 • Report of Article 6 Committee to Visa Group: Technical feasability questionned
Strategic Committee 22 June 2005 Decision: • No biometric identifiers in the visa but storage of biometrics only in the VIS. • Adaptation of the proposal regarding residence permits.
Residence Permits (RP) • Commission adopted in March 2006 a modified proposal (COM(2006) 110 final) for an amendment of Regulation 1030/2002 laying down a uniform format for residence permits for third country nationals that is now being discussed in the Council. • the proposal is aiming at giving up the sticker version and to issue RP only in card format including biometrics (contactless chip+ 2 flat fingerprints+ digitized image of the face) but it also allows the use of a contact chip, left optional to MS, if they want to implement e-government applications , digital signature…etc
Passports and other travel documents • Council decision of 13 December 2004 (Regulation (EC) 2252/2004): • The facial image will be required at the latest 18 months, • the fingerprints will be required mandatory at the latest 36 months after the date of adoption of technical specifications necessary for the implementation of the Regulation Participants: all MS except UK, IE + NO, IS, SW.
Passports and other travel documents • Commission decision on the technical specifications related to the integration of the facial image on 28 February 2005 ( http://europa.eu.int/comm/justice_home/doc_centre/freetravel/documents/doc_freetravel_documents_en.htm ) • Supplementary decision to be taken on rendering the access to fingerprint data secure (« extended access control ») • Implementation date of the facial image for all participating states: 28 August 2006
Identity Cards Meeting with Member States on 18 April 2005 • Presentation of MS national projects on identity cards including e-government. • Report from the Commission services on the state of play and possible ways ahead for the first SCIFA meeting under UK presidency. • Constitution would have enabled legally binding measure it is no longer the case.
ID Cards • New resolution of Representatives of Member States meeting within the Council on 1/2 December 2005 setting out standards for issuing procedures and requesting minimum standards by the Article 6 committee. • Document on minimum security standards established by the Article 6 committee
