  4. Controlled Substance and Alcohol Testing • Purpose to prevent accidents • Applies to operators of CMVs • Testing must be done by Part 40 • Some tests may be waived by the state

  7. Prohibited Conduct • Alcohol Concentration greater than 0.04 • No on-duty use of alcohol • No pre-duty consumption of alcohol for 4 hours • No post-accident use of alcohol for 8 hours after an accident • Refusal to take test • No use of controlled substances • No work if test positive.
