III. REGISTRAR MODELEC REGULATION 874/2004: Provisions for Registrars • No geographical limitations for registrars but: • Must be accredited by registry • Must offer agreements under a EU law • EU data protection • Can only take pre-registrations when accredited • Must submit applications in the order in which they were taken • .EU Registrations can only start if it is possible to register in any one of the 20 official EU languages ICANN - EURid presentation

REGISTRAR MODELREGISTRAR AGREEMENT: key requirements In respect of registrants: • Guarantee that the holder has accepted EURid registrant Terms and Conditions when registering • Guarantee that the holder meets the requirements to obtain or renewa name (particularly those in the EC regs. 733/2002 & 874/2004) • Inform the holder of all information received from EURid which might influence the holder’s contractual relationship with the registry (particularly regarding potential termination of the domain name registration) ICANN - EURid presentation

REGISTRAR MODEL REGISTRAR AGREEMENT: key requirements In respect of registrants: • Submit the data of the end-user requesting a domain name (not the data of the registrar) including e-mail address • Registrars may register names for themselves but will refrain from warehousing • Not in any way initiate or assist in the selling or transfer of a name without using the correct EURid procedures. REGISTRAR MODELREGISTRAR AGREEMENT: Advance payment • Registrar to make an advance payment of at least €10,000 (ten thousand) • From this account registration fees deducted immediately and renewal fees deducted at the end of the month in which due • At the end of each month, the registrar will be invoiced for that month’s activities • All names not deleted by the end of the due month will automatically be renewed and invoiced • If the account reaches zero no further registrations can be made until the invoice is paid. • Generally, if an organisation ceases to be a .eu registrar any unused money on their account will be refunded at the end of the agreement term. REGISTRATION MODELBASIC PRINCIPLE • First come – first served • Minimum 2 characters • Exceptions : • Reserved lists : countries, registry, EC • Blocked lists : names not allowed at the first level xxx.eu • Phased registration • 2 letter names representing « cc » • All other names are allowed ; no proof needed after « sunrise » • Companies, organisations, people residing in E.U. Bad faith = to register a domain name - for the purpose of selling - to prevent a right holder from registering it - for the purpose of disrupting the professional activities of a competitor - personal name for which no demonstrable link exists between holder and name - … Legitimate intrest = - Prior to ADR name was used in connection with goods or service - Holder has been commonly known by the domain name even in absence of right - Holder is making legitimate and non-commercial or fair use of DN without intent to mislead consumers or harm the reputation of rightholder VI. ADR REGULATION 874/2004 - art 21 • ADR enforced through T&C • What is an abuse ? • When a domain name is identical or confusingly similar to a name (…) on which a right is recognized (…)AND • was registered without rights or legitimate interests in the name by its holderORthe domain name has been registered or is being used in bad faith. • The results are binding unless court proceedings are initiated within 30 days of the notification of the result ICANN - EURid presentation

ADRSUNRISE ADR MECHANISM (1) • The sunrise ADR is an ADR against a decision of the registry / validation agent • The applicant who gets a negative decision, can start ADR against that decision : • When the decision is overruled, that applicant will get the name • When the decision is confirmed, the process continues (validating the rest of the queue) • In case of a positive decision : • All applicants lower in the queue will be informed by e-mail • They can start ADR against the decision • When the decision is overruled, the next in the queue has to be evaluated ICANN - EURid presentation
