  7. Food Service Agreement TERM. The Term of this Agreement shall be (5) years commencing on July 1, 2002 and ending on June 30, 2007, with options to renew for two (2) additional periods of two (2) years (each a “Renewal Term”) upon written agreement at the end of the Term or the first Renewal Term (“The option”). The option shall be exercised by the parties’ mutual agreement to do so expressed in writing a least (60 days) prior to the end of the Term or the first Renewal Term. All terms and conditions of the agreement may survive or be negotiated as terms in the amendment covering the Renewal Term(s)

Quality All Food, drinks, beverages,confections, and other items sold or kept for sale at South Commons shall be of first quality, wholesome and pure and must conform in all respects to all applicable federal, state and county health laws,statutes, ordinances and regulations. No imitation, adulterated or misbranded products shall be sold or kept for sale, and all other products must be handled with due regard for sanitation. Contractor will comply with industry standards of beer, wine, and other alcoholic beverages regarding quality, quantity, storage and handling.

Prices Contractor shall post in a conspicuous place at each bar and stand, whether permanent or temporary, a complete list of prices of all products offered for sale in connection with Concession Services and shall develop menu pricing for Catering Services. The content and manner of posting of each list, including the style and size of the signs, shall be subject to the approval of the City which approval shall not be unreasonably withheld. The contractor shall notify the city of all proposed price increases during the Term. In the event the City objects to any price increases proposed by contractor and the parties are unable to reach agreement as to the price, a minimum average annual increase of five percent (5%) shall be allowed for both Concessions Services and Catering Services
