    2. Overview of the new law Background and demand for the new law Came into force 6 April 2008 New statutory offence “corporate manslaughter” Common law corporate manslaughter abolished Key feature - “senior management” must be involved in the breach

    3. The Existing Health and Safety Regime Every employer must ensure : “so far as is reasonably practicable, the health, safety and welfare at work of all his employees” (Section 2) , and “to conduct his undertaking in such a way as to ensure……that persons not in his employment, who may be affected thereby are not exposed to risks to their health and safety” (Section 3).
