  1. At-Large issues related to new gTLD creation December 11 2009 Evan Leibovitch

  2. Carried over from DAGv2 • At-Large comments were made at the Summit • Most issues in that report were not addressed • Do we express concern about lack of consideration?

  3. Untouched from DAG2 to DAG3 • Price for applicants • Especially for community applications that aren't using the TLD mainly for revenue production • Punitive “refund” system for partial bids • Why not a graduated “pay by the stage” system? • The Morality and Public Order objection • Nobody wants it, but everyone thinks we need one • Can we propose an alternative (maybe together with GAC)? • Maybe just a “banned word” list?

  4. Untouched from DAG2 to DAG3 • Categorizations • Still just “community” and “non-community” • Lack of further splits denies fast-tracking for non-controversial applications • Differential pricing • How many are optimal? • Intellectual Property • Indiginous peoples' “Traditional Knowledge” unacknowledged

  5. Modified in DAG3, but still bad • String confusion – there is still allowance for objections based “meanings” of strings • Also similar “meaning” to trademarks • Dispute Resolution Service Providers • Parties should be allowed to choose their own mediator • Independent Objector • Fixed budget and an obligation to bear same costs as any other objector • Will this limit how effective the IO can be?

  6. Not yet dealt with • Unregistered trademarks • We didn't have a position before on “common law” marks, but this came up in debate over the IRT • High Security Zone Verification • Is it worth anything without WHOIS accuracy? • They're looking for guidance on this, it seems • Expressions of Interest • Not now part of DAG, but could appear in DAG4

  7. Not yet dealt with • Trademark issues • Alan and Olivier participating with GNSO • We may still need to make our own comments • Anything else?
