  1. National Tribal Labor Ordinances Survey John Dossett, General Counsel National Congress of American Indians

  2. Background • As a result of the February 2007 San Manuel v. National Labor Relations Board (DC - Circuit - 05-1392) ruling, tribal governments are receiving increasing national attention in their role as employers. • Congress is also considering amendments to the National Labor Relations Act that will make it easier to form unions, the Employee Free Choice Act.

  3. NCAI/NIGA Survey Partnership • The National Congress of American Indians and the National Indian Gaming Association have partnered to collect information from tribes through a national survey. The purpose of the survey is to educate Congress on tribal governments’ role as employers. • This information is being collected by NCAI’s Policy Research Center and will be used by NCAI and NIGA to advocate to Congress and the Administration against federal preemption of tribal labor ordinances.

Survey Questions NCAI/NIGA Survey Asks Tribes: • Number of Indian and Non-Indian employees • Whether the tribe has a labor relations ordinance in place • If the tribe does have an ordinance, what it regulates (i.e., anti-discrimination, family and medical leave, wages, etc.) • Other policies the tribe might have in place to protect employees on the reservation • Employment preferences the tribe may have in place • Benefits offered to tribal employees • Presence of a Tribal Employment Rights Office (TERO)

  5. NCAI/NIGA Survey Partnership Survey Methodology • Survey questions were developed and vetted by a team of field experts • Survey was launched on May 15th • Survey is entirely web-based • As of June 10th, 27 tribes have completed the survey

Next Steps We need your help • We encourage you to fill out the survey and have your tribe represented by June 30th. • The more tribes we have represented, the easier it will be to advocate to Congress and the Administration against federal preemption of tribal labor ordinances and to treat tribes the same as other governments. • This is a critical front in which to protect tribal sovereignty.
