TIMELY DECISION MAKING • Statutory Timelines • Section 59 of the Planning & Environment Act and Regulation 26 of the Planning & Environment Regulations 1998. • 60 days from lodging of the permit application in which to make a decision • Under the act Council does not have to wait for a referral authority to respond

  4. THE IMPORTANCE OF ADHERING TO TIMELINES • VCAT - failure to decide • Delays in planning decision can add costs to projects • PPARS • Community expectation

Conditions on permits • A condition must fairly and reasonably relate to the permitted development • A condition must serve a planning purpose • A the conditions should directly relate to the purpose of the referral and to the referral authorities area of responsibility • Specific requirements that are enforceable by the RA • Not conflicting with other referral authority requirements • Back up at VCAT
