Checks and Balances • Idea of separation of powers comes from Enlightenment philosopher Montesquieu • The concept of checks and balances is to keep one branch of the government from having too much power • Congress has checks on the President • The President has checks on Congress • The Supreme Court has judicial review, a check on both

Article IV • Section 1-States must honor the laws, records, and court decisions of other states • Section 2-Rights of citizens • Section 3-Admission of new states and congressional authority in new territory • Section 4-Protection of the states and citizens thereof by the US government
Article V Article VI • Amendments (changes) to the Constitution can be made with a 2/3 vote in both houses of Congress • OR 2/3 of the state legislatures request, with ratification of the amendment by ¾ of the states • The US government is supreme authority; federal law will override state law • Aka the “supremacy clause”

The Constitution-September 17, 1787 “We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.” In one paragraph the writers of the Constitution set out their plan for government.
