When do you need an ILA?” • Possible merger, Annexation, RFA, Contracting for services • Job losses due to any of the above • Transfer of employment from one entity to another.
Why do we need to do an ILA? • ILA’s ensures everyone plays fair • Protects jobs and benefits • Put down on paper a plan for how both locals are going to treat each other moving forward
Locals that have completed or are working on an ILA • Yakima & Union Gap • Mt. Vernon & Skagit County Medics • South King & VRFA • Wenatchee, Douglas #2, Chelan #1 • Hanford & Richland • Spokane Airport & City of Spokane • Caldwell ID & Middleton Fire District ID
What is covered in an ILA • Maintenance of Seniority • Pension maintenance • Rank • Accumulated benefits • Promotions • Physical agility and medical exams • Job assignments
What is covered in an ILA(continued) • Other conditions of employment, preservation of - Licenses (drivers, EMTs, age) - “Redline” salaries (when exceeds new salary structure) i.e. with no loss in salary - No wage or benefit adjustments prior to merger • Consolidation or Merger of Bargaining Units.
What the IAFF Requires in an ILA • No one gets hurt. • No loss of Seniority • No loss of Rank • No loss of wages or Benefits PUT YOURSELF IN THE OTHER GUYS SHOES
How do we start the process? • Contact IAFF District Vice President Walsh • An IAFF State Representative will be assigned to assist in the process. • The State Rep will bring both parties together
How does the process work? • Much like negotiations • Both locals meet and sculpt your agreement • Once the document is finished the DVP reviews and confirms the document
How does the process work?(Continued) • Upon the DVP’s approval both locals present the ILA to their membership. • The entire membership of each Bargaining Unit vote up or down on the ILA. • Once both locals pass the ILA sign 3 copies • One for each local and one for the DVP
Affects on the Employers • Does this document bind/affect the employer? • No this document is the framework for how either local is going to negotiate with there employers regarding any issue outlined in the ILA. • How does an ILA force and employer to comply? • They have to negotiate with you the affects or change in working conditions.
Local Mergers • When do we look at merging our bargaining units into one local? • Potential for agency consolidation, merger, RFA or Contracting for services. • Why do we do a merger? • Assists in controlling the above situations • Do we need to do an ILA before working on a Merger? • Typically you should have an ILA in place but it is a necessity.
Local Mergers • How do we start the merger process? • Contact the DVP or your assigned state Rep if you are in the ILA process. • Receive an IAFF Merger Packet • Both locals begin merger discussions
Mergers Items to address • Financials • Emergency Defense Funds • Benevolence Funds • Outstanding debits • Any other local monies or funds • Consolidation of funds • Dues Structure • Executive Board composition
Mergers Items to address (Cont) • Constitution and By-Laws Merger/Changes • Will there be separate Bargaining Units within the new merged local. • Local Number post merger • Typically the lower local number will prevail but there are exceptions.
Summary • If you are in doubt about needing an ILA contact District Vice President Walsh sooner than later. • Talk with other locals about the ILA experience • Always keep an open line of communication with the other local • Make sure you put yourself in the other guys shoes.
