  2. Exhibit D A petitioned electric transmission line has to indicate that 1. It is necessary to serve a public use 2. It represents a reasonable relationship to an overall plan of transmitting electricity in the public interest. Refer to Iowa Code Section 478.3 for requirements.

  3. The Iowa Administrative Code Chapter 11 (or 199 IAC 11) • Contains the rules on filing of petitions and exhibits for electric transmission line franchise for: • New franchise • Amended franchise • Extension of franchise • Abbreviated franchise • There are certain exhibits required for each type of franchise (Exhibits A thru G) and there are specific requirements per exhibit. Exhibit D is where to indicate the what, why, and where for the petitioned line.

  4. For a new or amended franchise, Exhibit D shall include such statements and allegations found in: • Iowa Code Section 478.3 • 199 IAC 11.2(1)”d”(1) thru (5) • Any other information in support of the line and the petition • Common errors of Exhibit D for new/amended franchise are: • No explanation for deviation(s) from division lines of lands, roads or railroads as required in 199 IAC 11.2(1)”d”(2) • Proposing separate pole lines in road ROW without requesting board authorization as required in 199 IAC 11.2(1)”d”(3) • Inconsistent mileage figures between Exhibit D and the petition and/or Exhibits A, B, or C. • In relation to 199 IAC 11.3(6), termini (stations) identified by a name, • but no location information provided • Repeated errors from petition to petition Exhibit D

  5. For an extension of franchise, Exhibit D shall include such statements and allegations found in: • Iowa Code Section 478.3 • 199 IAC 11.2(2)”d”(1) thru (5) • Any other information or explanation in support of the petition • Common errors of Exhibit D for an extension of franchise are: • 199 IAC 11.2(2)”d”(1), original company name as to whom franchise granted, not listed • Applying for an extension from expired franchise • Overlooking of rule 199 IAC 11.2(2)”d”(2) by not listing all amendments of existing franchise • Repeated errors from petition to petition Exhibit D

  6. For an abbreviated franchise, Exhibit D shall consist such statements and allegations found in: • Iowa Code Section 478.3 • 199 IAC 11.2(3)”d”(1) thru (4) • Common errors of Exhibit D for an abbreviated franchise are: • NONE?? • (Believe it or not) Exhibit D

  7. Exhibit F • Is a way of communicating about a petitioned line to potentially affected utilities near and along the line. • Exhibit F applies to petitions of: • New franchise • Amended franchise • Abbreviated franchise • But not required for an extension of franchise.

  8. For a new/amended franchise’s Exhibit F, Refer to 199 IAC 11.5(4) which lists of potentially affected parties found in: • 199 IAC 11.2(1)”b”(6) thru (11) • Iowa Department of Transportation (IDOT) • which are the Exhibit B’s utilities list plus IDOT. • Affected parties are utilities located within 0.6 mile, railroads, and airports and landing strips within 1.0 mile from petitioned line. • Common errors of Exhibit F’s list are: • Inconsistency of addresses between two Exhibits (F and B) • Incorrect county name in a notification letter Exhibit D

  9. For an abbreviated franchise, Exhibit F’s list of potentially affected parties would be similar to those for a new and amended petitions, but not including: • IDOT • Airports and landing strips • utilities that are not crossed by or not in shared right-of-way (ROW) with the petitioned line • Note that “In shared right-of-way” could range from a public road ROW width, or a private ROW width to a combination of public and private ROWs. • Common errors of Exhibit F’s list are: • NONE?? • (Believe it or not) Exhibit D

  10. Exhibit G • Exhibit G applies to petitions of: • New franchise (w/ info. mtg. only) • Amended franchise (w/ info. mtg. only) • Abbreviated franchise • But not required for an extension of franchise.

  11. For a new or amended franchise (w/ info. Meeting), Exhibit G is an affidavit on the holding of info. Meeting. Refer to • Iowa Code Section 478.3.2 • 199 IAC 11.2(1)”g” • Common errors related to Exhibit G are: • Expired or no expiration date of notary public in an affidavit • Not a valid (expired) notarization as of an info. meeting’s published notice • Incomplete copy of an info. meeting’s published notice Exhibit D

  12. For an abbreviated franchise, Exhibit G is the form of notice (not an affidavit) to owners of and persons residing on properties where construction will occur. Also refer to • 199 IAC 11.2(3)”g” and • 199 IAC 11.5(11) • A list of the owners of and persons residing on affected properties who will get this letter is not required. • Common errors related to Exhibit G are: • NONE??
