GOAL, PURPOSE AND RESULTS OF PROJECT • Goal: “to continue to pursue joint efforts for fostering a harmonised reform and integration process in the transport sector across the SEE region and to support the improvement in the efficiency of the SEE Core Regional Transport Network” • Purpose and the results: “Assisting the participants of SEE Core Regional Transport Network for implementing 2007 – 2011 MAP soft measures in: • Railway infrastructure access & pricing regime and network statements; • Railway border crossings; RWR/RSA Consultant: WYG – TRADEMCO – VIENNA CONSULT - TRL

RAILWAY REFORM ACTIVITIES • Review of available studies • Legal framework analysis (EC Directives and transposition to relevant national legislation • Review of institutional capacity and condition in each country • Proposal for harmonised tariff approach • Draft Regulatory Manual • Draft Network Statement • Action Plan for implementing access charging RWR/RSA Consultant: WYG – TRADEMCO – VIENNA CONSULT - TRL

RAILWAY BORDER CROSSING ACTIVITIES • Analysis of existing situation • Data collection • Review of bilateral agreements and of best practices • Review of procedures of technical acceptance • Analysis of driving training • Monitoring of performance at BCPs • Passenger control on moving trains • Draft regional plan for border crossing facilitation • Electronic data interchange system (EDI) for freight • Action Plan for implementing recommendations RWR/RSA Consultant: WYG – TRADEMCO – VIENNA CONSULT - TRL

  5. 3. OVERALL ACHIEVEMENTS • Related to railway refrom • The former Yugoslav Republic of Macedonia intends to shift TAC principle from FC- to MC+ . It also plans to adjust its adopted NS to the Harmonised NS; • Serbia plans to adjust the TAC methodology and the NS proposed previously by other consultant, to the proposals made by the Project; • Kosovo (under UNSCR 1244/99) modifies its current version of railway NS in view of the proposal of the Project for harmonised procedures. Nevertheless lump sum TAC access is proposed for the time being; • HZ IM formed a working group on 19.10.09 to prepare the NS 2011, taking into considerations the recommendations of the project; • The importance and the role of regional harmonisation and integration is gradually understood by all SEETO Participants, although it is clear that national policies influence or will influence the actual establishment of this harmonisation/integration.

OVERALL ACHIEVEMENTS  Related to border crossing facilitation • proposed BC Agreements are considered in new agreements signed or being discussed between several Participants. • in Croatia, HZ Passengers, asked RW Directorate to prepare the necessary agreements for passenger control on moving trains, according to our proposal, first with Slovenia. • Agreement on interconnection of networks shall be the basis for the HZ IM to invite the neighbouring IM to negotiations. • Agreement on wagon transfer will be the basis for the re-negotiation of the present agreement on mutual acceptance of freight wagons between HZ Cargo and SZ of Slovenia. • The Regional Agreement on mutual recognition of train driver certificates was discussed between Participants.   7. 5. MAIN RESULTS FOR BORDER CROSSINGS OUTPUT FROM PHASE 1 (Analysis) 1. No BCA is in compliance with EU legislation (the 18 criteria) 2. No mutual acceptance of traction 3. No mutual acceptance of rolling stock on trust (Exception HZ-SZ) although members of CUU 3. “Technologies” are for integrated state RW only, even if already separated. 4. No mutual recognition of train driver training although training is almost identical. 5. Significant delays at BCPs due to lack of communication and collaboration among the stakeholders. 6. MAIN RESULTS FOR BORDER CROSSINGS SPR 6: “Draft regional plan for BC facilitation ” The Regional Plan deals with: • The challenges and methods of implementation of the proposals • The implementation of proposed agreements with the help of the Regional Plan • The time schedule which shall be presented and in its revised version in Activity A.2.4, the Action Plan. MAIN RESULTS FOR BORDER CROSSINGS Implementation steps: • Step 1: To be initiated by the competent stakeholder or even stakeholders of at least 2 SEETO Participants. • Step 2: First draft presented by the initiating party from Step 1 • Step 3: Negotiations opened either bilaterally or multilaterally, depending on the intentions of the initiating parties (and their joint commissions) • Step 4: Negotiations finished, draft approved by the competent joint commission • Step 5: Ready for signature. MAIN RESULTS FOR BORDER CROSSINGS SPR 7: “Passenger Control on Moving trains ” • With the implementation of the BCA and the BPA border control on moving trains has its legal bases. • Major challenge is the execution of border control activities on territories of the neighbouring state. COMPETITIVE ADVANTAGES: • No necessity to have controls in standing trains • No necessity to have controls before boarding and/or after disembarking as it is the case for air and bus RWR/RSA Consultant: WYG – TRADEMCO – VIENNA CONSULT - TRL

MAIN RESULTS FOR BORDER CROSSINGS SPR 8: “Electronic Data Interchange Systems for Freight ” 6 steps to implementation: • STEP 1: Install Minimum IT and EDI-Equipment at the BCP • STEP 2: Establish Automatic Train Recognition Using ATRS-RFID • STEP 3: Interconnect EDI-Systems of two separate BCPs • STEP 4: Interconnect EDI of BCPs and hinterland offices • STEP 5: Establish automatic train check systems at specific locations • STEP 6: Connect Operational Dispatch Level (ODL) and Commercial Dispatch Level (CDL) vertically RWR/RSA Consultant: WYG – TRADEMCO – VIENNA CONSULT - TRL

MAIN RESULTS FOR BORDER CROSSINGS SPR 9: “Action Plan for implementing recommendations” The Action Plan further details the Regional Plan by: • Defining what is to be implemented (Agreements and Regional Decisions as above) • Defining the stakeholders responsible for the implementation (who) • Defining in detail the time schedule (when) • Outlining the resources if necessary (how) • Proposing the monitoring system for a successful implementation of the proposed actions.

MONITORING Monitoring of Action Plans for Railway Reform and Border Crossings • An efficient and transparent monitoring is the key to a successful implementation of the Action Plan. • Regional monitoring for regional harmonisation and integration,. Proposal: RW WG will be responsible for monitoring supported by SEETO Secretariat They will monitor the performance of all Participants • Members of the RW WG come from the relevant ministries • Chairman is from DG TREN ( direct link with EC). • RW WG directly reports to the SEETO Steering Committee. • SEETO Secretariat as permanent member of the RW WG ensures close cooperation and acts as rapporteur
