Paraprofessional Requirements • an Associate’s degree or higher; OR • have completed two years of study at an institute of higher education, OR • passed a rigorous state or local assessment demonstrating one of the following: • Knowledge of and the ability to assist in instructing in the core academic subject areas; • Reading readiness, writing readiness, or mathematics readiness, as appropriate

Institution of Higher Education – Paraprofessional Requirements • admits as regular students only persons having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate; • is legally authorized within such State to provide a program of education beyond secondary education; • provides an educational program for which the institution awards a bachelor’s degree or provides not less than a two-year program that is acceptable for full credit toward such a degree; • is a public or other non-profit institution; and • is accredited by a nationally recognized accrediting agency or association or, if not so accredited, is an institution that has been granted pre-accreditation by such an agency or association that has been recognized by the Secretary for the granting of pre-accreditation status, and the Secretary has determined that there is satisfactory assurance that the institution will meet the accreditation standards of such an agency or association within a reasonable time. NCLB: Section 9101(24)

LEA consequences for not reaching 100% HQ Teachers • Highly Qualified Teacher Continuous Improvement Planning process • LEA must submit a Highly Qualified Teacher Focused Data Analysis (HQTFDA) AND • a Highly Qualified Teacher Continuous Improvement Plan (HQTCIP). • By December 15, 2012 • Content Requirements for Letters Submitted in Lieu of HQTFDA and HQTCIP

  16. Exceptions to consequences • If not HQ due to multi-subject new special education teacher or multi-subject rural teacher flexibility • NOT required to submit interventions to TEA • Interventions are to be maintained locally • Must send letter to NCLB notifying them that this is what they are doing

  17. Exceptions to consequences cont’d. • If not 100% HQ on 9/16/13 (“as of date”) but 100% by 12/16/13, the LEA must: • Update campus report(s) on website AND • Submit a letter to NCLB stating that are now 100% HQ

  20. 230.1 Definitions (14) Mentor– A certified educator who is assigned by the campus administrator and who has completed, within the past three years, mentor training provided by an educator preparation program, education service center, campus, or school district. Responsibilities of the mentor include, but are not limited to: (A) guiding, assisting, and supporting the beginning teacher in areas such as acquisition of instructional materials, classroom management, curriculum and instruction, district policy, parent involvement, and student assessment; and (B) providing information to the educator preparation program regarding the progress of the beginning teacher seeking a new certification.

Subchapter D – Types and Classes of Certificates 230.37 – Probationary Certificates (e)(1)Demonstrate knowledge of each subject area to be taught: (A) at the elementary school level (EC-6) by passing an appropriate certification examination. (B) at the middle or high school level (Grades 7-12) (i) by passing an appropriate content area certification examination, (ii) completing coursework that complies with TEC §21.050 and comprised of not fewer than 24 semester credit hours, including 12 semester credit hours of upper division coursework in the subject area taught, or (iii) in the case of CTE assignments based on skill and experience, by satisfying requirements for that subject area contained in § 233.14 (relating to Career and Technical Education Certificates requiring experience and preparation in a skill area).

Subchapter D – Types and Classes of Certificates 230.37 – Probationary Certificates (e)(2)The individual in a special education classroom teaching assignment must demonstrate both knowledge in special education and knowledge of each subject to be taught, (A) at the elementary school level (EC-6), (i) by passing a certification examination appropriate to the grade level or subject matter assignment, and (ii) by passing a special education examination (B) at the middle or high school level (Grades 7-12) (i) by either (I) passing a certification examination appropriate to the individual’s subject matter assignment, or (II) completing coursework comprised of not fewer than 24 semester hours, including 12 semester hours of upper division coursework in the subject area taught, and, (II) by passing a special education examination.

Subchapter D – Types and Classes of Certificates 230.37 – Probationary Certificates (f) Probationary certificate for professional class certificates: Superintendent, Principal, School Counselor, School Librarian, Educational Diagnostician, Reading Specialist, and Master Teacher - meet all requirements prescribed by the EPP, based on the qualifications and requirements for the class of certification sought and duties to be performed by the holder of a certificate in that class - be accepted and enrolled in an approved EPP - be assigned in the professional class certification area being sought in a Texas school district, open-enrollment charter school or other school approved by TEA. - subject to all the terms and conditions of a probationary certificate

Subchapter E – Educational Aide Certificates 230.53 (c) An applicant for an educational aide certificate must be able to communicate, listen, read, write and comprehend the English language sufficiently to use it easily and readily in daily communication. See 230.11(b)(1)-(5) forgeneral requirements and options for meeting English proficiency.

Subchapter F – Permits 230.77 (g) Assignment for other instructional and support personnel (3) School Librarian (EC-12) must: (A) hold a bachelor’s degree (B) have completed 12 semester credit hours directly related to the basic competencies required of school librarians (C) have two creditable years of classroom teaching experience

Subchapter F – Permits 230.77 (g) Assignment for other instructional and support personnel (4) Reserve Officers’ Training Corps (ROTC) instructor: (A) An individual must verify that he or she has satisfied requirements and been approved to serve by the ROTC, (B) An ROTC instructor permit may not be renewed, but must be reissued every year. NOTE: Districts will no longer be able to carry the ROTC instructor each year of renewal on a service record, but must apply and pay for a permit each year.

  27. Subchapter F – Permits 230.81 Renewal Requirements and Procedures (5) (D)Renewals must be completed online prior to the beginning date of duties for the current school year and (E) The school district must pay the appropriate fee. Local renewal is no longer available.

  28. Bilingual Permit clarification - “Demonstrate proficiency in comprehension and expression by having a passing score on an appropriate SBEC approved examination” • Defined as BTLPT for Bilingual Spanish • ACTFL for other languages

  29. Chapter 232 – Subchapter A 232.7 Requirements for Certificate Renewal (a)(1) TEA shall notify educators by email at least 6 months prior to the expiration date. (2) TEA shall consider requests for hardship extension of renewal for: - catastrophic illness of the educator or an immediate family member. - military service of the educator.

Chapter 232 – Subchapter A 232.15 Types of Acceptable CPE Activities (a)(1) participating in institutes, workshops, seminars, conferences, interactive distance learning, video conferencing, online activities, and in-service or staff development by an approved provider or sponsor, which are related to or enhance the professional knowledge and skills of the educator. Staff development through accredited public or private schools in other states, U.S. territories, or countries can be accepted.

Chapter 232 – Subchapter A 232.15 Types of Acceptable CPE Activities (a) (2) undergraduate or graduate courses or training taken for credit through an accredited institution of higher education (3) independent study (20% limit) (4) developing, teaching, or presenting CPE (10% limit) (5) mentor another educator (30% limit) Principal Assessment no longer included since this activity was repealed by the legislature and removed from Chapter 241 requirements related to the Principal certificate.

Language Proficiency Exams for Bilingual Certification Texas Oral Proficiency Test (TOPT) is no longer given or accepted for certification Bilingual Target Language Proficiency Test (BTLPT) is used for bilingual certification when the target language is Spanish American Council on the Teaching of Foreign Languages (ACTFL) – for bilingual in languages other than Spanish – oral and written tests required

  34. Service Record Clarifications • TRS rules ≠ TEA rules • TEC vs. TAC • If dock days, service record #days worked decreases • 1 year of service per line • Must create service record for ALL employees • substitute teachers (note certified or not) • Does NOT need to be certified in Texas

Personal Leave Days • 5 days available at beginning of year • Ability to pro-rate if they leave • Days for ALL employees (PT, FT, retirees, etc.) • “value” of day depends on regular workday hours • District can NOT restrict order of use of leave balances • CAN have fractions of days as a balance

  36. Charter Schools • NOT required to issue state days • NOT required to meet state minimum salary schedule • NOT required to have Chapter 21 contracts

Criminal History Reminder • TAA letter (10/8/12) - IDENTIFICATION REQUIREMENTS FOR CHILD PROTECTIVE SERVICES INVESTIGATORS TEC §38.022(a) • authorizes a school to require school visitors to display either a driver’s license or some other unspecified form of government photographic identification. • does not authorize retaining a paper copy of a driver’s license or other personal identification. • Thus, if a driver’s license is not required for electronic database purposes, a CPS photographic identification card may be accepted for identification purposes, and further verification, if deemed necessary, may be obtained by calling the local CPS office. • Questions?
